(AP Photo/Jon Elswick, File)2025-05-06T18:13:36Z WASHINGTON (AP) The Supreme Court on Tuesday allowed President Donald Trumps administration to enforce a ban on transgender people in the military, while legal challenges proceed.The court acted in the dispute over a policy that presumptively disqualifies transgender people from military service.The courts three liberal justices said they would have kept the policy on hold.Just after beginning his second term in January, Trump moved aggressively to roll back the rights of transgender people. Among the Republican presidents actions was an executive order that claims the sexual identity of transgender service members conflicts with a soldiers commitment to an honorable, truthful, and disciplined lifestyle, even in ones personal life and is harmful to military readiness.In response, Defense Secretary Pete Hegseth issued a policy that gives the military services 30 days to figure out how they will seek out and identify transgender service members to remove them from the force. Three federal judges had ruled against the ban.In the case the justices acted in Tuesday, U.S. District Court Judge Benjamin Settle in Tacoma, Washington, had ruled for several long-serving transgender military members who say that the ban is insulting and discriminatory and that their firing would cause lasting damage to their careers and reputations. The Trump administration offered no explanation as to why transgender troops, who have been able to serve openly over the past four years with no evidence of problems, should suddenly be banned, Settle wrote. The judge is an appointee of Republican President George W. Bush and is a former captain in the U.S. Army Judge Advocate General Corps. Settle imposed a nationwide hold on the policy and a federal appeals court rejected the administrations emergency plea. The Justice Department then turned to the Supreme Court. The policy also has been blocked by a federal judge in the nations capital, but that ruling has been temporarily halted by a federal appeals court, which heard arguments last month. The three-judge panel, which includes two judges appointed by Trump during his first term, appeared to be in favor of the administrations position. A documentary shown at Sundance in January, The Stringer, asserts that it was actually shot by another man, Nguyen Thanh Nghe, but that credit was given to Ut, an AP staff photographer.The AP concluded that it was possible Ut took the photo, but it was unable to be proven conclusively due to the passage of time, absence of key evidence, limitations of technology and the deaths of several key people involved. At the same time, AP found no proof that Nguyen took the photo, the report said.We left nothing uncovered that were aware of and weve done it with a great deal of respect to everybody involved, said Derl McCrudden, an AP vice president who heads global news production. It makes no difference to us if we changed the credit, but it has to be based on facts and evidence. And there is no definitive evidence proving that Nick Ut did not take this picture.The APs latest study involved further interviews, examination of cameras, building a 3D model of the scene and studying photo negatives that survive from June 8, 1972, the date of the photo. The report said that believing Nguyens story would require several leaps of faith, including believing that the only time he ever sold a photo to a Western news agency it turned out to be one of the most famous images of the century.An attorney for Ut did not immediately return an email Tuesday. On Monday NBC News reported that another hacker had targeted the same company, and TeleMessage suspended service in response to the breaches.Communications from several federal agencies, including the most senior national security officials, have been recklessly entrusted to TeleMessage, a foreign company that purports to offer agencies a secure tool to archive messages sent using Signal, the popular secure messaging app, Senator Ron Wydens letter reads. The Washington Post first reported the existence of the letter.It would be hard to imagine a less secure way for U.S. government agencies to retain employee messages than decrypting, copying to, and processing those messages on a poorly secured server operated by a foreign company, the letter adds. This can be a useful, or sometimes legally necessary, service for government agencies and regulated industries like financial institutions. Adding that archive capability, however, undermines the security of robustly encrypted messaging apps like Signal and introduces significant risk. As 404 Medias reporting on the hack shows, those threats are far from theoretical and very much real.The hacker provided 404 Media with some TeleMessage users message contents; the names and contact information for government officials; usernames and passwords for other parts of TeleMessages infrastructure; and screenshots that indicated what companies or agencies may also be TeleMessage customers. The hacker said the whole process took about 15-20 minutes.In a New York Times article before 404 Media broke news of the hack, Tom Padgett, the president of Smarshs enterprise business, said we do not de-encrypt, meaning messages werent decrypted while being collected for archiving, the letter says.These claims are plainly false, the letter adds. 404 Medias coverage found that some archived Signal messages were in plaintext, meaning they were not encrypted and were obtained by the hacker.Government agencies using TeleMessage have given their users something that looks and feels like Signal, the most widely trusted secure communications app. But instead, senior government officials have been provided with a shoddy Signal knockoff that poses a number of serious security and counterintelligence threats, the letter says.It remains unclear whether the design of this system was merely the result of incompetence on the part of the foreign company, whose senior leadership are former intelligence officers, or a backdoor designed to facilitate foreign intelligence collection against U.S. government officials. Regardless, TeleMessages dangerously insecure design should have been discovered long before the companys app was installed on the phone of the Presidents national security advisor and, presumably, other senior White House officials, it continues. The TeleMessage episode started when Reuters photographed then-U.S. National Security Advisor Mike Waltz using TeleMessages version of Signal, 404 Media first reported.The letter then directly urges the Department of Justice to investigate, saying TeleMessage appears to have misled the federal government about the security of its products by claiming to provide end-to-end encryption when it does not; and for an investigation into the counterintelligence threat posed by the company, including whether the company has shared U.S. government communications with the Israeli government, and whether the Israeli government played any role in the products dangerous design.Smarsh did not immediately respond to a request for comment.A copy of an Smarsh FAQ sent to customers obtained by 404 Media says it is not possible to register new users. The Drug Enforcement Administration has quietly ended its body camera program barely four years after it began, according to an internal email obtained by Propublica. On April 2, DEA headquarters emailed employees announcing that the program had been terminated effective the day before. The DEA has not publicly announced the policy change, but by early April, links to pages about body camera policies on the DEAs website were broken. The email said the agency made the change to be consistent with a Trump executive order rescinding the 2022 requirement that all federal law enforcement agents use body cameras.But at least two other federal law enforcement agencies within the Justice Department the U.S. Marshals Service and the Bureau of Alcohol, Tobacco, Firearms and Explosives are still requiring body cameras, according to their spokespeople. The FBI referred questions about its body camera policy to the Justice Department, which declined to comment. The DEA did not respond to questions about its decision to stop using the cameras, saying that the agency does not comment on tools and techniques. Reuters reported on the change as part of a story about budget cuts for law enforcement offices. One former federal prosecutor expressed concern that the change would make life more difficult for DEA agents. The vast majority of times I viewed body camera footage is based on allegations from a defense attorney about what a cop did, said David DeVillers, former U.S. attorney for the Southern District of Ohio. And I would say 95% of the time it absolves the cop of wrongdoing. The Justice Department started requiring that its federal agents wear the devices in 2021 in the wake of the protests over George Floyds death the previous summer.We welcome the addition of body worn cameras and appreciate the enhanced transparency and assurance they provide to the public and to law enforcement officers working hard to keep our communities safe and healthy, then-DEA Administrator Anne Milgram said in a Sept. 1, 2021, press release announcing the use of the cameras. In May 2022, then-President Joe Biden issued an executive order expanding the use of body cameras to all federal law enforcement officers. In January, the incoming Trump administration rescinded that order, along with almost 100 others it considered harmful. In early February, U.S. Immigration and Customs Enforcement, which is part of the Department of Homeland Security, was one of the first agencies to get rid of its body cameras. Subsequent videos show plainclothes immigration agents making arrests with no visible body cameras.The DOJ wrote in a 2022 Office of Inspector General management report that the cameras were a means of enhancing police accountability and the publics trust in law enforcement. Studies have consistently shown that departments that use body cameras experience a drop in complaints against officers, according to the nonprofit Police Executive Research Forum, though its not clear if the drop is due to improvements in officer behavior or to a decrease in frivolous complaints.Eliminating these videos is really taking away a tool that weve seen be of benefit to law enforcement practices, said Cameron McEllhiney, executive director of the National Association for Civilian Oversight of Law Enforcement. Its also a great teaching tool, besides keeping community members safe from the potential misconduct that could occur.The DOJ put a lot of money into the body camera initiative. In August of 2021, it awarded Axon, the company that dominates the body camera market, a $30.4 million contract for cameras and the software to handle the evidence they created. The contract, according to Axon, remains active. But only about one-sixth of it has been paid out, according to federal contracting data. The most recent publicly available version of the DEAs body camera policy dates to December 2022. It only required agents to wear the devices when they were conducting preplanned arrests or searches and seizures that required a warrant. It also only required DEA officers to wear their body cameras when they were working within the United States. Agents had 72 hours after the end of an operation to upload their video evidence, unless there was a shooting, in which case they were instructed to upload the video evidence as soon as possible. The policy laid out in detail how and by whom evidence from the cameras should be handled in the event officers used force, and it authorized the DEA to use the video evidence when investigating its own officers. The DEA had planned to implement the policy in phases so that eventually its officers nationwide would be wearing the devices when serving warrants or carrying out planned arrests. In its 2025 fiscal year budget request to Congress, the agency asked for $15.8 million and 69 full time employees, including five attorneys, to enable the DEAs phased implementation plan of nationwide use of Body Worn Cameras. Records obtained via Freedom of Information Act request by Citizens for Responsibility and Ethics in Washington show that the Biden-era DOJ had an ambitious plan to capture agencywide metrics and data about the efficiency and use of body cameras by its law enforcement officers.Laura Iheanachor, senior counsel at CREW, said that before federal law enforcement started wearing body cameras, several local police agencies had declined to participate in federal task forces because doing so would have forced their officers to remove their cameras.
