AGREEMENT TO TERMS
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and VibeForge LLC, doing business as VibeForge ("VibeForge", “we”, “us”, or “our”), concerning your access to and use of the VibeForge website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.
The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The Site is not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subjected to such laws, you may not use this Site. You may not use the Site in a way that would violate the Gramm-Leach-Bliley Act (GLBA).
The Site is intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site. If you are a minor, you must have your parent or guardian read and agree to these Terms of Use prior to you using the Site.
ADULT CONTENT
Do Not Post content displaying genitals or focusing in on fully exposed buttocks. We also restrict some images of female breasts if they include the nipple, but our intent is to allow images that are shared for medical or health purposes. We also allow photos of women actively engaged in breastfeeding or showing breasts with post-mastectomy scarring. We also allow photographs of paintings, sculptures and other art that depicts nude figures.
Do Not Post images of sexual activity. Restrictions on the display of sexual activity also apply to illustrated and digitally created content unless the content is posted for educational, humorous or satirical purposes. Explicit images of sexual intercourse are prohibited.
Do Not Describe sexual acts in vivid detail. Descriptions of such acts that go into vivid detail may be removed.
You agree that if at any time you violate these rules, your content can be removed and/or account suspended for 7 days. If the content posted violates state or federal law, we will immediately terminate your account and if required by law, we will report your content and provide information to Law Enforcement Agencies.
INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.
USER REPRESENTATIONS
By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not under the age of 13; (5) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Site; (6) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise; (7) you will not use the Site for any illegal or unauthorized purpose; and (8) your use of the Site will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).
USER REGISTRATION
You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
PROHIBITED ACTIVITIES
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a user of the Site, you agree not to:
- Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
- Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein.
- Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.
- Use any information obtained from the Site in order to harass, abuse, or harm another person.
- Make improper use of our support services or submit false reports of abuse or misconduct.
- Use the Site in a manner inconsistent with any applicable laws or regulations.
- Engage in unauthorized framing of or linking to the Site.
- Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site.
- Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
- Delete the copyright or other proprietary rights notice from any Content.
- Attempt to impersonate another user or person or use the username of another user.
- Sell or otherwise transfer your profile.
- Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
- Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site.
- Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you.
- Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.
- Copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
- Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.
- Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software.
- Use a buying agent or purchasing agent to make purchases on the Site.
- Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
- Use the Site as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavor or commercial enterprise.
USER GENERATED CONTRIBUTIONS
The Site may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the Site and through third-party websites. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:
- The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
- You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Site, and other users of the Site to use your Contributions in any manner contemplated by the Site and these Terms of Use.
- You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Site and these Terms of Use.
- Your Contributions are not false, inaccurate, or misleading.
- Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
- Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us).
- Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
- Your Contributions do not advocate the violent overthrow of any government or incite, encourage, or threaten physical harm against another.
- Your Contributions do not violate any applicable law, regulation, or rule.
- Your Contributions do not violate the privacy or publicity rights of any third party.
- Your Contributions do not contain any material that solicits personal information from anyone under the age of 18 or exploits people under the age of 18 in a sexual or violent manner.
- Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors;
- Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
- Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Service, or any applicable law or regulation.
Any use of the Site in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site.
CONTRIBUTION LICENSE
By posting your Contributions to any part of the Site or making Contributions accessible to the Site by linking your account from the Site to any of your social networking accounts, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, re-title, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sub-licenses of the foregoing. The use and distribution may occur in any media formats and through any media channels.
This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.
We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site. You are solely responsible for your Contributions to the Site and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.
We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations on the Site; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.
GUIDELINES FOR REVIEWS
We may provide you areas on the Site to leave reviews or ratings. When posting a review, you must comply with the following criteria: (1) you should have firsthand experience with the person/entity being reviewed; (2) your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language; (3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability; (4) your reviews should not contain references to illegal activity; (5) you should not be affiliated with competitors if posting negative reviews; (6) you should not make any conclusions as to the legality of conduct; (7) you may not post any false or misleading statements; and (8) you may not organize a campaign encouraging others to post reviews, whether positive or negative.
We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.
MOBILE APPLICATION LICENSE
Use License
If you access the Site via a mobile application, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the mobile application on wireless electronic devices owned or controlled by you, and to access and use the mobile application on such devices strictly in accordance with the terms and conditions of this mobile application license contained in these Terms of Use. You shall not: (1) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the application; (2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the application; (3) violate any applicable laws, rules, or regulations in connection with your access or use of the application; (4) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the application; (5) use the application for any revenue generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended; (6) make the application available over a network or other environment permitting access or use by multiple devices or users at the same time; (7) use the application for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the application; (8) use the application to send automated queries to any website or to send any unsolicited commercial e-mail; or (9) use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the application.
Apple and Android Devices
The following terms apply when you use a mobile application obtained from either the Apple Store or Google Play (each an “App Distributor”) to access the Site: (1) the license granted to you for our mobile application is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms of service; (2) we are responsible for providing any maintenance and support services with respect to the mobile application as specified in the terms and conditions of this mobile application license contained in these Terms of Use or as otherwise required under applicable law, and you acknowledge that each App Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the mobile application; (3) in the event of any failure of the mobile application to conform to any applicable warranty, you may notify the applicable App Distributor, and the App Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the mobile application, and to the maximum extent permitted by applicable law, the App Distributor will have no other warranty obligation whatsoever with respect to the mobile application; (4) you represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country and (ii) you are not listed on any U.S. government list of prohibited or restricted parties; (5) you must comply with applicable third-party terms of agreement when using the mobile application, e.g., if you have a VoIP application, then you must not be in violation of their wireless data service agreement when using the mobile application; and (6) you acknowledge and agree that the App Distributors are third-party beneficiaries of the terms and conditions in this mobile application license contained in these Terms of Use, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce the terms and conditions in this mobile application license contained in these Terms of Use against you as a third-party beneficiary thereof.
SOCIAL MEDIA
As part of the functionality of the Site, you may link your account with online accounts you have with third-party service providers (each such account, a “Third-Party Account”) by either: (1) providing your Third-Party Account login information through the Site; or (2) allowing us to access your Third-Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third-Party Account. You represent and warrant that you are entitled to disclose your Third-Party Account login information to us and/or grant us access to your Third-Party Account, without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account, and without obligating us to pay any fees or making us subject to any usage limitations imposed by the third-party service provider of the Third-Party Account. By granting us access to any Third-Party Accounts, you understand that (1) we may access, make available, and store (if applicable) any content that you have provided to and stored in your Third-Party Account (the “Social Network Content”) so that it is available on and through the Site via your account, including without limitation any friend lists and (2) we may submit to and receive from your Third-Party Account additional information to the extent you are notified when you link your account with the Third-Party Account. Depending on the Third-Party Accounts you choose and subject to the privacy settings that you have set in such Third-Party Accounts, personally identifiable information that you post to your Third-Party Accounts may be available on and through your account on the Site. Please note that if a Third-Party Account or associated service becomes unavailable or our access to such Third Party Account is terminated by the third-party service provider, then Social Network Content may no longer be available on and through the Site. You will have the ability to disable the connection between your account on the Site and your Third-Party Accounts at any time. PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD-PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH THIRD-PARTY SERVICE PROVIDERS. We make no effort to review any Social Network Content for any purpose, including but not limited to, for accuracy, legality, or non-infringement, and we are not responsible for any Social Network Content. You acknowledge and agree that we may access your email address book associated with a Third-Party Account and your contacts list stored on your mobile device or tablet computer solely for purposes of identifying and informing you of those contacts who have also registered to use the Site. You can deactivate the connection between the Site and your Third-Party Account by contacting us using the contact information below or through your account settings (if applicable). We will attempt to delete any information stored on our servers that was obtained through such Third-Party Account, except the username and profile picture that become associated with your account.
SUBMISSIONS
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site ("Submissions") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.
THIRD-PARTY WEBSITE AND CONTENT
The Site may contain (or you may be sent via the Site) links to other websites ("Third-Party Websites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties ("Third-Party Content"). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site or any Third-Party Content posted on, available through, or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content. Inclusion of, linking to, or permitting the use or installation of any Third-Party Websites or any Third-Party Content does not imply approval or endorsement thereof by us. If you decide to leave the Site and access the Third-Party Websites or to use or install any Third-Party Content, you do so at your own risk, and you should be aware these Terms of Use no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any website to which you navigate from the Site or relating to any applications you use or install from the Site. Any purchases you make through Third-Party Websites will be through other websites and from other companies, and we take no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party. You agree and acknowledge that we do not endorse the products or services offered on Third-Party Websites and you shall hold us harmless from any harm caused by your purchase of such products or services. Additionally, you shall hold us harmless from any losses sustained by you or harm caused to you relating to or resulting in any way from any Third-Party Content or any contact with Third-Party Websites.
ADVERTISERS
We allow advertisers to display their advertisements and other information in certain areas of the Site, such as sidebar advertisements or banner advertisements. If you are an advertiser, you shall take full responsibility for any advertisements you place on the Site and any services provided on the Site or products sold through those advertisements. Further, as an advertiser, you warrant and represent that you possess all rights and authority to place advertisements on the Site, including, but not limited to, intellectual property rights, publicity rights, and contractual rights. We simply provide the space to place such advertisements, and we have no other relationship with advertisers.
SITE MANAGEMENT
We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.
PRIVACY POLICY
We care about data privacy and security. Please be advised the Site is hosted in the United States. If you access the Site from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United States, then through your continued use of the Site, you are transferring your data to the United States, and you agree to have your data transferred to and processed in the United States. Further, we do not knowingly accept, request, or solicit information from children or knowingly market to children. Therefore, in accordance with the U.S. Children’s Online Privacy Protection Act, if we receive actual knowledge that anyone under the age of 13 has provided personal information to us without the requisite and verifiable parental consent, we will delete that information from the Site as quickly as is reasonably practical.
COPYRIGHT INFRINGEMENTS
We respect the intellectual property rights of others. If you believe that any material available on or through the Site infringes upon any copyright you own or control, please immediately notify us using the contact information provided below (a “Notification”). A copy of your Notification will be sent to the person who posted or stored the material addressed in the Notification. Please be advised that pursuant to applicable law you may be held liable for damages if you make material misrepresentations in a Notification. Thus, if you are not sure that material located on or linked to by the Site infringes your copyright, you should consider first contacting an attorney.
TERM AND TERMINATION
These Terms of Use shall remain in full force and effect while you use the Site. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by either Party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in Wasco, Oregon. Except as otherwise provided herein, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.
If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Wasco, Oregon, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the the Uniform Computer Information Transaction Act (UCITA) is excluded from these Terms of Use.
In no event shall any Dispute brought by either Party related in any way to the Site be commenced more than one (1) years after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable, and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
Restrictions
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Informal Negotiations and Arbitration
The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

A buyer is obligated to complete the transaction of a purchase of an item on Marketplace in any shop within three (3) days. A buyer is obligated to immediately pay in full if using PayPal by clicking the payment button during checkout. A seller must abide by all of Marketplace's policies and the seller's own individual shop policies and sell and the item as described. Likewise, a seller must abide by the seller's own individual policies when dealing other issues, for example, issues of damage and returns. Buyers remorse is not a valid reason for requesting a refund from a seller. Prior to making a purchase, buyers should review all sellers policies regarding refunds, returns, and seller policies.

Marketplace's Fees and Credit Policy
Changes to the Fees and Credits Policy and the fees for our services are effective after Marketplace provides you with at least fourteen (14) days' notice of the changes by posting the changes on Marketplace. However, Marketplace may choose to temporarily change Marketplace's Fees and Credits Policy and the fees for Marketplace's services for promotional events (for example, free listing days) and such changes are effective when Marketplace posts the temporary promotional event on Marketplace. Listing Description: You must be legally able to sell the item(s) you list for sale on the Site. You must describe your item and all terms of sale on the listing page of the Site. Each listing must accurately and completely describe the item/items for sale in that listing. If the "in stock" quantity is more than one, all items in that listing must be identical. Each unique item must have its own listing. Listings may not contain outbound links that direct users off of Marketplace.
Binding Sale: All sales are binding. Termination: Without limiting any other remedies, Marketplace, without notice, may suspend or terminate your account if Marketplace suspects, in its sole discretion, that you (by information, investigation, conviction, settlement, insurance or escrow investigation, or otherwise) have violated any of Marketplace's policies set out in this Agreement, the Privacy Policy, or any other policy documents or community guidelines, or you have engaged in an improper or fraudulent activity in connection with Marketplace. If Marketplace terminates a listing or your account, if you close your account, or if the payment of your seller fees cannot be completed for any reason, you remain obligated to pay Marketplace for all unpaid fees plus any penalties, if applicable. If the seller's account is not paid in full and becomes past due, Marketplace reserves the right to attempt to collect past due fees by charging the seller's card on file. The seller risks additional penalties such as the suspension of privileges and/or termination of the account and other collection mechanisms (including retaining collection agencies and legal counsel). If you have a question or wish to dispute a charge, contact Marketplace support.
Manipulation: The price stated in each Marketplace Item Description must be an accurate representation of the sale. Manipulation refers to activities whereby the price no longer accurately represents the monetary value of the transaction. For example manipulative activities include, but are not limited to, intentionally stating one price in the Item Description but charging a higher price to the buyer, altering the item's price prior to a sale for the purpose of avoiding Marketplace transaction fees, and hacking into another account and altering prices. Neither buyer nor seller, may manipulate the price of any item for any reason. Sellers have up to 90 days from the date of the transaction to request refunds on the final value fees. Final value fee refund requests on transactions outside of 90 days will not be honored.
V. Usage Guidelines
Third Party Content; Identity Verification: You understand that the Marketplace, including Marketplace booth chat, acts only as a marketing platform and technical interface between users and that Marketplace does not itself verify the qualifications of users, nor does it evaluate or control in any ongoing manner exchanges between users. Any opinions or statements expressed by a user are of those of the user alone, and are not to be attributed to Marketplace. Marketplace cannot and does not assume responsibility for the accuracy, completeness, safety, reliability, timeliness, innocuousness, legality or applicability of anything said, written, posted, displayed or otherwise made available by any user. You understand that you may be exposed to content that you find offensive to you, and that you use the Marketplace at your own risk. Please use caution, common sense, and practice safe trading when using Marketplace. Please note that there are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals. By using Marketplace, you agree to accept such risks and that Marketplace (and our officers, directors, agents, subsidiaries, joint ventures and employees) is not responsible for any and all acts or omissions of users on Marketplace Marketplace uses many techniques to verify the accuracy of the information Marketplace's users provide to Marketplace when they register on Marketplace. However, because user verification on the Internet is difficult, Marketplace cannot and does not confirm each user's purported identity. Thus, Marketplace has established a user-initiated feedback system to help you evaluate with whom you are dealing. Marketplace also encourages you to communicate directly with potential transaction partners through the tools available on Marketplace. You may also wish to consider using a third party escrow service or services that provide additional user verification.
Prohibited, Questionable and Infringing Usage; Restricted Activities: Your Activities which results in Your Information (or any items listed) on Marketplace shall not: (a) be false, inaccurate or misleading; (b) be fraudulent or involve the sale of illegal, counterfeit, stolen items or items which violate the Terms of Use in any way; (c) infringe upon any third party's copyright, patent, trademark, trade secret or other proprietary or intellectual property rights or rights of publicity or privacy; (d) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); Marketplace also does not permit the listing of items that have been identified by the U.S. Consumer Products Safety Commission (CPSC) as hazardous to consumers and therefore subject to a recall; (e) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (f) be obscene or contain child pornography (g) contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (h) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; and (i) link directly or indirectly to or include descriptions of goods or services that: (aa) are prohibited under this Agreement, the Privacy Policy, or other policy documents and community guidelines as posted on Marketplace or; (bb) are identical to other items you have for sale but are priced lower; (cc) are concurrently listed for sale on a web site other than Marketplace's (this does not prevent linking to or advertising an Marketplace item from another web site); or (dd) you do not have a right to link to or include. Furthermore, you may not list any item on Marketplace (or consummate any transaction that was initiated using our service) that, by paying to us the listing fee or the final value fee, could cause us to violate any applicable law, statute, ordinance or regulation, or that violates the Terms of Use.
Access and Interference: Marketplace may contain robot exclusion headers. Much of the information on Marketplace is updated on a real time basis and is proprietary or is licensed to Marketplace by Marketplace's users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access Marketplace for any purpose without our prior express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose, in our sole discretion, an unreasonable or disproportionately large load on our infrastructure; (ii) copy, reproduce, modify, create derivative works from, distribute or publicly display any content from the Site without the prior expressed written permission of Marketplace and the appropriate third party, as applicable; (iii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iv) bypass our robot exclusion headers or other measures we may use to prevent or restrict access to Marketplace.
Feedback Integrity; Feedback Export: You may not take any actions that may undermine the integrity of the feedback system. Marketplace may, without prior notice, limit the number of purchases and listings, which you may place on Marketplace based upon the level of your feedback. If you earn a low percentage feedback rating, your account will automatically be flagged for staff review, at which time your membership may be fully or partially suspended, and you may be unable to list or buy. You acknowledge that your feedback consists of comments left by other users and a composite feedback number compiled by Marketplace. Further, you acknowledge that the composite number, without the feedback comments, does not convey your full user reputation. Because feedback ratings are not designed for any purpose other than for facilitating transactions between Marketplace users, you agree that you shall not market or export your Marketplace feedback rating in any venue other than a Marketplace operated website.
VIII. Miscellaneous Terms and Conditions
Breach: Without limiting other remedies available, Marketplace may, without prior notice, limit your activity, immediately remove your item listings, warn Marketplace's community of your actions, issue a warning, temporarily suspend, indefinitely suspend or terminate your membership (without refunding any fees) and refuse to provide our services to you if: (a) you breach this Agreement or other policy documents and community guidelines this Terms of Use incorporates by reference; (b) Marketplace is unable to verify or authenticate any of Your Information; or (c) Marketplace believes that your actions may cause financial loss or legal liability for you, Marketplace's users or Marketplace. No Warranty: MARKETPLACE, MARKETPLACE'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND MARKETPLACE'S SUPPLIERS PROVIDE MARKETPLACE'S WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. MARKETPLACE, MARKETPLACE'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND MARKETPLACE'S SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.
Limitation On Liability: IN NO EVENT SHALL MARKETPLACE, AND (AS APPLICABLE) MARKETPLACE'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR MARKETPLACE'S SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE). MARKETPLACE'S LIABILITY, AND (AS APPLICABLE) THE LIABILITY OF MARKETPLACE'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO MARKETPLACE IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $100. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Legal Compliance: You agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service and your listing, purchase, solicitation of offers to purchase, and sale of items.

This policy describes how Marketplace collects and handles your personal information when you use our Site. Love Your Group
The fun part is getting your group off the floor. A little bit of time and love will go a long way in creating a successful group. Here are some tips:
- Choose a good name for your group: something that is descriptive and calls to people.
- Write a good group description: people want to know what they are joining.
- Start new discussion on a daily basis: people are always looking for good discussions.
- Tell people about your group: friends, like minded people… anyone who might enjoy it.
- Just be yourself and have fun with it: fun and authenticity, nothing is more important.
Find Good Group Moderators to Help You Out
What makes a good group moderator? Someone who shares your vision for the group. Someone who will contribute regularly to the group and help you moderate and maintain it. You can never have enough good group leaders to help you out. What happens if it does not work out with one of the group leaders you choose? No worries. A group owner can not only add new moderators to the team but remove any of them if needed.
We Are Very Open Minded - But Certain Content Is A No-No
Certain topics are prohibited on VibeForge. Some of them are for legal reasons and others are from limitations put on us by banks and credit card companies. You can have intellectual discussions, but you cannot post content that is considered obscene by community standards such as: Nudity, Porn, or any acts that portray violence against others including animals. See our Legal & Privacy policies for a platform wide explanation of prohibited content. As group owners and moderators, we would appreciate you moderating these subjects appropriately. If we have to moderate your content, you will be notified via a private message of the content that was removed for violations of our guidelines and policies. You as a group owner can (and we encourage it) write your own group guidelines so long as they do not interfere with platform wide rules and guidelines.
Don't Let People Ruin It For Others
We want you to encourage healthy debate but there is a big difference between that and a discussion which has degraded into people attacking one another. Aggressive personal attacks, criminal accusations, making fun of, trolling, flaming, bullying, racial slurs or any other type of malicious behavior that lowers the quality of a discussion needs to be moderated quickly before things get out of control and ruin the experience for everyone. Example:
"I think you are dumb f*** with two peas for a brain for wanting to kick a poor defenseless animal. You should be dragged out into the street and get karate chopped by Chuck Norris."
Now this needs to be edited or removed.
Taking Care of Your Group
When you come across any content that needs to be moderated we recommend you remove it and email the poster to explain to them why it needed to go. Copying and pasting the original content back is always appreciated so that they don't lose any of the good stuff while just removing the bad stuff. In addition to moderating content you can also close and re-open a discussion to give people the chance to cool-down and gather their thoughts. If a member of your group continuously causes problems then we recommend you ban them from your group. Once you ban a member from your group it's a good idea to send a friendly head's up to us at report@vibeforge.co and let us know what is going on.

We always recommend to members of the community that they first contact you if they see or are having any problems in your group. Groups are a big part of VibeForge and group administrators play a large role in making sure that everyone enjoys participating in groups on VibeForge. To make sure that group leaders are all on the same page we wrote the following list of general Group Leader Guidelines we would like all group leaders to follow. Just remember, participation on VibeForge is always subject to our Legal & Privacy Policies.
See a Need, Fill a Need, Start a Group
Have a new idea for a group? Can't find a group that speaks to you? Want to start a group to promote your business, event or organization. Then just do it already. Start a new group.
Love Your Group
The fun part is getting your group off the floor. A little bit of time and love will go a long way in creating a successful group. Here are some tips:
- Choose a good name for your group: something that is descriptive and calls to people.
- Write a good group description: people want to know what they are joining.
- Start new discussion on a daily basis: people are always looking for good discussions.
- Tell people about your group: friends, like minded people… anyone who might enjoy it.
- Just be yourself and have fun with it: fun and authenticity, nothing is more important.
Find Good Group Moderators to Help You Out
What makes a good group moderator? Someone who shares your vision for the group. Someone who will contribute regularly to the group and help you moderate and maintain it. You can never have enough good group leaders to help you out. What happens if it does not work out with one of the group leaders you choose? No worries. A group owner can not only add new moderators to the team but remove any of them if needed.
We Are Very Open Minded - But Certain Content Is A No-No
Certain topics are prohibited on VibeForge. Some of them are for legal reasons and others are from limitations put on us by banks and credit card companies. You can have intellectual discussions, but you cannot post content that is considered obscene by community standards such as: Nudity, Porn, or any acts that portray violence against others including animals. See our Legal & Privacy policies for a platform wide explanation of prohibited content. As group owners and moderators, we would appreciate you moderating these subjects appropriately. If we have to moderate your content, you will be notified via a private message of the content that was removed for violations of our guidelines and policies. You as a group owner can (and we encourage it) write your own group guidelines so long as they do not interfere with platform wide rules and guidelines.
Don't Let People Ruin It For Others
We want you to encourage healthy debate but there is a big difference between that and a discussion which has degraded into people attacking one another. Aggressive personal attacks, criminal accusations, making fun of, trolling, flaming, bullying, racial slurs or any other type of malicious behavior that lowers the quality of a discussion needs to be moderated quickly before things get out of control and ruin the experience for everyone. Example:
"I think you are dumb f*** with two peas for a brain for wanting to kick a poor defenseless animal. You should be dragged out into the street and get karate chopped by Chuck Norris."
Now this needs to be edited or removed.
Taking Care of Your Group
When you come across any content that needs to be moderated we recommend you remove it and email the poster to explain to them why it needed to go. Copying and pasting the original content back is always appreciated so that they don't lose any of the good stuff while just removing the bad stuff. In addition to moderating content you can also close and re-open a discussion to give people the chance to cool-down and gather their thoughts. If a member of your group continuously causes problems then we recommend you ban them from your group. Once you ban a member from your group it's a good idea to send a friendly head's up to us at report@vibeforge.co and let us know what is going on.

Safe Space Guidelines
Everyone deserves to feel safe and secure in who they are.
As part of our commitment to you, our servers track all IP addresses connecting to our platform and the accounts they are associated with. This information only provided to Law Enforcement in cases of emergency or legal issues arising from actions taken from your account.
Participants must be 15 years old or older. (All platform rules will be enforced in addition to Safe Space Guidelines)
If you are uncomfortable, give a limited introduction of yourself such as first name only, use an avatar that does not show your face.
If you are uncomfortable with having your face on screen you can turn video function off, or put it on to introduce yourself and then switch off.
A pronoun is how you refer to someone, for example using she or they. Please ask people what their pronouns are if you are meeting them for the first time. Use their correct pronouns, even if the words are unfamiliar to you. If you make a mistake and refer to someone with the wrong pronoun, apologize and move on.
Don’t make assumptions about someone’s identity and think about the ways that people from minority groups may be impacted in different ways by the issues you discuss. Be aware that your experiences as a gay, lesbian, bi, trans, queer or non-binary person are not necessarily the same as everybody else in the group/platform. Be aware of any position and privileges you may bring regarding for example your race, your class, your gender identity, your ability or your age. Try not to make generalizing statements such as 'All gay men hate women'.
Racism, sexism, classism, homophobia, biphobia, transphobia, ableism, fatphobia, ageism or discrimination on basis of ethnicity, immigration status, or religious, cultural, and/or spiritual beliefs, or any other kind of oppressive behavior is unacceptable and will be challenged. Please do not use slurs that are not yours to use: e.g if you are white do not use racial slurs, even if you are being critical of them. Please give a choice for people to interact without having to talk if they don’t want to, If they are neurodivergent, do not tell people off if they want to talk about a subject, give space to people to go at their own pace.
There is a zero tolerance policy to sexual harassment. This means no pornography and/or nudity of any kind, including but not limited to, adult pornography, Anime, child pornography, "adult content" and/or the written word of a sexual nature. This also means no inappropriate sexual comments or sexually based jokes, songs or taunts. (Platform wide rules apply as well.)
Try to use clear, uncomplicated language and to avoid any acronyms and in-jokes. If you mention a theory or person, please give a brief description of who they are, no matter how well known you believe they are.
Give people a heads up if you are going to discuss something that others might find upsetting. Sometimes upsetting things happen and we need to be able talk about how we deal with them as a community. It’s important to have a space where we feel able to do this, and we hope that this event will provide that. However, not everyone is able to talk about everything all the time, so let people know if you are going to talk about something potentially upsetting, such as mental illness or domestic abuse. You can also do this informally by asking ‘is it okay if I talk about X thing?’ Be sure to wait for a couple of responses before posting about your topic of discussion.
|Please be aware that it is difficult for those belonging to marginalized groups or minority groups to participate in discussions online. Do not hijack the conversations even if it is appropriate for you to speak on certain topics. Try to give less confident and quieter people a chance to speak.
We will ask everybody to respect the fact that not everybody is “out” everywhere outside of our platform so if you use other social media platforms, please do not share any contact information or identifiable information of other people without their explicit consent.

Deleting Your VibeForge Account
Parting Ways: VibeForge Account Deletion
This document outlines the terms and conditions regarding the deletion of your VibeForge account. We understand that sometimes circumstances change, and your journey may lead you on a different path. While we are saddened to see you go, we respect your decision and strive to ensure a smooth and transparent process.
Reasons for Deletion:
While not mandatory, understanding your reason for deletion helps us improve and serve the community better. Please select from the following:
- Moving onwards: You've decided that VibeForge no longer is for you, or you just need a break.
- Seeking privacy: You wish to minimize your online presence or address data concerns.
- Other reasons: Unspecified circumstances necessitate your departure. Share these briefly in the feedback section.
Understanding the Implications:
Deletion is permanent and irreversible. Upon confirming your request, your profile, posts, comments, and interactions will be irrevocably erased. Consider the following:
- Content preservation: Download or back up any desired content before proceeding. We cannot recover deleted data.
- Residual traces: Your comments and contributions to discussions pre-deletion might remain, with your username anonymized.
- Financial aspects: Outstanding user points or paid subscriptions are forfeited upon deletion.
Data Retention and Compliance:
VibeForge prioritizes data privacy and adheres to relevant regulations. While your account vanishes, specific information might be retained for legal or compliance purposes. This data is anonymized and excludes any personally identifiable details.
The Deletion Process:
- Login: Access your VibeForge account.
- Settings: Navigate to "Settings" and then "Account Management."
- Confirmation: Click "Delete Account" and confirm your decision.
- Finality: Your account is permanently deleted.
To change your email address, navigate to Settings > Account Settings, and update your email. Don't forget to save the changes.
To enhance your account security, go to Settings > Security > Two-Factor Authentication, and enable Two-Factor Authentication (2FA). Follow the instructions to link your mobile device.

Malicious Email
A malicious email can look just like it comes from a financial institution, an e-commerce site, a government agency or any other service or business. It often urges you to act quickly, because your account has been compromised, your order cannot be fulfilled or there is another urgent matter to address. If you are unsure whether an email request is legitimate, try to verify it with these steps:
- Contact the company directly – using the information provided on any account statement, on the company’s official website or on the back of a credit card.
- Search for the company online – but not with the information provided in the email.
Spam
Spam is the electronic equivalent of junk mail. The term refers to unsolicited, bulk – and often unwanted – email. Here are ways to reduce spam:
- Enable filters on your email programs: Most internet service providers (ISPs) and email providers offer spam filters; however, depending on the level you set, you may end up blocking emails you want. It’s a good idea to occasionally check your junk folder to ensure the filters are working properly.
- Report spam: Most email clients offer ways to mark an email as spam or report instances of spam. Reporting spam will also help to prevent the messages from being directly delivered to your inbox.
- Own your online presence: Consider hiding your email address from online profiles and social networking sites or only allowing certain people to view your personal information.
Phishing
Phishing attacks use email or malicious websites (clicking on a link) to collect personal and financial information or infect your machine with malware and viruses.
Spear Phishing
Spear phishing involves highly specialized attacks against specific targets or small groups of targets to collect information or gain access to systems. For example, a cybercriminal may launch a spear phishing attack against a business to gain credentials to access a list of customers. From that attack, they may launch a phishing attack against the customers of the business. Since they have gained access to the network, the email they send may look even more authentic and because the recipient is already customer of the business, the email may more easily make it through filters and the recipient maybe more likely to open the email. The cyber criminal can use even more devious social engineering efforts such as indicating there is an important technical update or new lower pricing to lure people.
Spam & Phishing on Social Networks
Spam, phishing and other scams aren’t limited to just email. They’re also prevalent on social networking sites. The same rules apply on social networks: When in doubt, throw it out. This rule applies to links in online ads, status updates, tweets and other posts. Here are ways to report spam and phishing on major social networks:
- Reporting spam and phishing on Facebook

- Reporting spam and phishing on YouTube
Tips for Avoiding Being a Victim
- Don’t reveal personal or financial information in an email, and do not respond to email solicitations for this information. This includes following links sent in email.
- Before sending or entering sensitive information online, check the security of the website.
- Pay attention to the website’s URL. Malicious websites may look identical to a legitimate site, but the URL may use a variation in spelling or a different domain (e.g., .com versus .net).
- If you are unsure whether an email request is legitimate, try to verify it by contacting the company directly. Contact the company using information provided on an account statement, not information provided in an email. Check out the Anti-Phishing Working Group (APWG) to learn about known phishing attacks and/or report phishing.
- Keep a clean machine. Keep all software on internet-connected devices – including PCs, smartphones and tablets – up to date to reduce risk of infection from malware.
What to Do if You Are a Victim
- Report it to the appropriate people within the organization, including network administrators. They can be alert for any suspicious or unusual activity.
- If you believe your financial accounts may be compromised, contact your financial institution immediately and close the account(s).
- Watch for any unauthorized charges to your account.
- Consider reporting the attack to your local police department, and file a report with the Federal Trade Commission or the Internet Crime Complaint Center.
Protect Yourself With These Tips
- When in doubt, throw it out: Links in email, tweets, posts and online advertising are often how cybercriminals try to compromise your information. If it looks suspicious, even if you know the source, it’s best to delete or – if appropriate – mark it as junk.
- Think before you act: Be wary of communications that implores you to act immediately, offers something that sounds too good to be true or asks for personal information.
- Make your password a sentence: A strong password is a sentence that is at least 12 characters long. Focus on positive sentences or phrases that you like to think about and are easy to remember (for example, “I love country music.”). On many sites, you can even use spaces!
- Unique account, unique password: Having separate passwords for every account helps to thwart cybercriminals. At a minimum, separate your work and personal accounts and make sure that your critical accounts have the strongest passwords.
- Lock down your login: Fortify your online accounts by enabling the strongest authentication tools available, such as biometrics, security keys or a unique one-time code through an app on your mobile device. Your usernames and passwords are not enough to protect key accounts like email, banking and social media.

Malware and Botnets
Viruses
Viruses are harmful programs that can be transmitted to computers and other connected devices in a number of ways. Although viruses differ in many ways, all are designed to spread themselves from one device to another and cause havoc. Most commonly, viruses are designed to give the criminals who create them some sort of access to the infected devices.
Spyware
The terms “spyware” and “adware” apply to several different technologies. The two important things to know about them are that:
- They can download themselves onto your device without your permission (typically when you visit an unsafe website or via an attachment).
- They can make your computer do things you don’t want it to do, such as as opening an advertisement you didn’t want to see. In the worst cases, spyware can track your online movements, steal your passwords and/or compromise your accounts.
Botnets
Botnets are networks of computers infected by malware (such as computer viruses, key loggers and other malicious software) and controlled remotely by criminals, usually for financial gain or to launch attacks on websites or networks. If your computer is infected with this malware and part of a botnet, it communicates and receives instructions about what it’s supposed to do from “command and control” computers located anywhere around the globe. What your computer does depends on what the cyber-criminals are trying to accomplish. Many botnets are designed to harvest data, such as passwords, Social Security numbers, credit card numbers, addresses, telephone numbers and other personal information. The data is then used for nefarious purposes, such as identity theft, credit card fraud, spamming (sending junk email), website attacks and malware distribution.
Ransomware
Ransomware is a type of malware that accesses a victim’s files, locks and encrypts them and then demands the victim to pay a ransom to get them back. Cyber-criminals use these attacks to try to get users to click on attachments or links that appear legitimate but actually contain malicious code. Ransomware is like the “digital kidnapping” of valuable data – from personal photos and memories to client information, financial records and intellectual property.
