What Happened: A federal judge ruled on Monday that the Trump administrations termination of hundreds of grants by the National Institutes of Health was void and illegal, ordering some of them to be reinstated, including many profiled by ProPublica in recent months.District Judge William G. Young made the ruling in two lawsuits challenging the Trump administrations directives and cancellations: One case was brought by more than a dozen states attorneys general, and the other was led by the American Public Health Association alongside several other organizations and researchers.In Mondays ruling, the judge determined that the directives that led to the grant terminations were arbitrary and capricious and said they had no force and effect. The judges ruling ordered the funding of the grants to be restored. It only covers grants that have been identified by the plaintiffs in the cases. What the Judge Said: After Young ruled that the agency directives and terminations were illegal, he noted that the governments practices were discriminatory.This represents racial discrimination, and discrimination against Americas LGBTQ community, he said. Thats what this is. I would be blind not to call it out. My duty is to call it out, and I do so.This year, the Trump administration banned the NIH from funding grants that had a connection to diversity, equity and inclusion, alleging that such research may be discriminatory. ProPublica previously found that caught up in mass terminations was research focused on why some populations including women and sexual, racial or ethnic minorities may be more at risk of certain disorders or diseases.I have never seen a record where racial discrimination was so palpable, Young said during Mondays hearing. Ive sat on this bench now for 40 years, and Ive never seen government racial discrimination like this, and I confine my remarks to this record, to health care.He also noted the administrations targeting of LGBTQ+ research. It is palpably clear these directives and the set of terminated grants here also are designed to frustrate, to stop research that may bear on the health we are talking about health here the health of Americans, of our LGBTQ community, he said. Thats appalling. Background: In recent months, ProPublica has been covering the toll of the grant cancellations by the NIH. More than 150 researchers, scientists and investigators have reached out to ProPublica and shared their experiences, revealing how the terminations are dramatically reshaping the biomedical and scientific enterprise of the nation at large. They described how years of federally funded research may never be published, how critical treatments may never be developed and how millions of patients could be harmed.Two and a half years into a three-year grant, and to all of a sudden stop and not fully be able to answer the original questions, its just a waste, said Brown University associate professor Ethan Moitra, whose grant studying mental health treatment for LGBTQ+ people was terminated. Response: White House spokesperson Kush Desai said it was appalling that a federal judge would use court proceedings to express his political views and preferences, adding that justice ceases to be administered when a judge clearly rules on the basis of his political ideologies.Desai also defended the administrations policies targeting diversity, equity and inclusion, calling it a flawed and racist logic. He also said that the administration was committed to restoring the Gold Standard of Science, which he claimed involves a recognition of the biological reality of the male and female sexes. The NIH, he said, is shifting research spending to address our chronic disease crisis instead, not to validate ideological activism.Andrew G. Nixon, the director of communications for the Department of Health and Human Services, told ProPublica that the agency stands by its decision to end funding for research that prioritized ideological agendas over scientific rigor and meaningful outcomes for the American people, and that it was exploring all legal options, including filing an appeal and moving to stay the order. Why It Matters: The mass cancellation of grants in response to political policy shifts has no historical precedent, experts told ProPublica, and marks an extraordinary departure from the agencys established practices. ProPublica previously revealed that the Department of Government Efficiency the administrations cost-cutting initiative gave the agency direction on what to cut and why, raising questions about the provenance of the terminations. The judge's ruling adds to a growing number of legal decisions halting or scaling back the administrations actions. As of Monday, according to The New York Times, there have been more than 180 rulings that have at least temporarily paused the administrations practices.Whether the administration follows Mondays ruling, however, remains an open question. As ProPublica reported, the NIH has previously terminated research grants even after a federal judge blocked such cuts, and the administration has disregarded several other rulings. If the vacation of these particular grant terminations, the vacation of these directives, taken as a whole, does not result in forthwith disbursement of funds, Young said in Mondays hearing, the court has ample jurisdiction. In 2023, U.S. District Judge Lynn Adelmanissued a preliminary injunction on an anti-trans policy at the Mukwonago Area School District located in the conservative Milwaukee suburb of Mukwonago which required students to use bathrooms and locker rooms based on their sex assigned at birth. Related A Christian spa claimed it had the right to discriminate against trans women. The court disagreed. A federal court denied the spas claim that its freedom of speech, assembly, and religion were violated. The trans girl, called D.P. in court documents, sued the school along with her mother after it began to heavily monitor her bathroom usage while she took summer classes at Mukwonago High School, even though she had used the girls bathroom for years without any problems. Defendants have begun enforcing the policy against plaintiff and are currently causing her to experience emotional and mental harms.The school appealed Adelmans injunction, arguing that the court violated due process by not holding a hearing before the decision. But the appeals court noted that the school did not request a hearing and that if there are no factual disputes, hearings are not required before a judge can issue a preliminary injunction.The court also ruled that D.P. is likely to succeed on her claims based on binding circuit precedent and said it would not overrule its pro-trans rights decisions in two other similar cases, Whitaker v Kenosha Unified School District and A.C. v Martinsville. In the latter, the court ruled in favor of three transgender students who were forbidden by their schools from using bathrooms matching their gender identities. In the former, it ruled in part that a Wisconsin school district had not provided a transgender student a sufficient alternative under Title IX by requiring him to use a gender-neutral bathroom that was inconveniently located and subjected him to stigmatization.The court did note, however, that the Supreme Courts forthcoming decision in United States v. Skrmetti which concerns Tennessees ban on gender-affirming care for trans youth andwill likely determine the future of gender-affirming care access nationwide could affect the merit of D.P.s claims, but until then, circuit precedent remains controlling.In D.P.s case, the injunction only applies to the individual student who sued. After the appeals court released its decision, Mukwonago Area School District superintendent Joe Koch told the Milwaukee Journal Sentinel the school will continue to enforce its anti-trans policy for every other student. The district, Koch said, will continue to defend the legality of its restroom/locker room use policy and stand up for the values of our community.A statement released by D.P.s mother when the initial lawsuit began expressed that she is heartbroken that my daughter has been subjected to ongoing discrimination from her own school district.Im furious that this is happening, and continuing to happen, to any kids who are part of the LGBTQ+ community, she added. No student should have to endure consistent invasions of their privacy and have their well-being threatened.MASD superintendent Joe Koch and the school board are targeting an eleven-year-old child, and that is disgusting. But it completely dropped its pursuit when they learned that his parents are gay.Rising high-school freshman Caleb Degala-Burnett and his dads, Mike Degala and Master Burnett, claim that coaches and administrators at Valley Christian, in Dublin, California, were impressed with the 14-year-old outfielders performance at a recent invite-only showcase and with his ranking as a college prospect and potential pro draft pick, according to the San Francisco Standard. The family says Valley Christian courted Caleb this past spring, going so far as to offer financial assistance to help cover the schools $24,000-per-year tuition. In a March 5 text message, Valley Christians baseball coach told Degala that Calebs name came up last night a few times and we really want him to be a part of a great school, according to The Standard. In a separate text, vice executive of schools Joe Fuca reportedly told Degala that Valley Christian was all in on Caleb playing varsity baseball for us next year. Degala says Fuca also expressed concern that the school would lose supporters if it enrolled Caleb.I felt angry about it, because it really shouldnt matter what your family is, Caleb told The Standard. It should matter about the student and how they are as a person.Ive never, to this magnitude, experienced this type of discrimination against our family, Degala told the paper. In this day and age, its crazy.However, as The Standard notes, it in fact remains legal for private schools to discriminate against students based on their sexuality or the sexual orientation of their parents. When the paper polled 10 Bay Area Christian high schools, only one responded saying it would accept LGBTQ+ students or students whose parents are LGBTQ+. Among those that did not respond, only one explicitly bans homophobia in its student handbook and employment policies. The paper cited four other Bay Area Christian high schools that explicitly reject homosexuality and same-sex marriage in their materials. Its legal on paper; its not morally right, Equality California communications director Jorge Reyes Salinas said. This is unacceptable regardless of the schools private or religious status.Responding to The Standards story, out California state Sen. Scott Wiener (D) blasted Valley Christians treatment of the Degala-Burnett family as absolutely vile.This kid just wants to go to school & play baseball. Hes a top talent. Yet, the school rejected him explicitly because his parents are gay, Wiener, who represents San Francisco, wrote in a June 17 Bluesky post. This kind of hatred is now escalating under our bigoted federal administration.
