Social media algorithms have broken our brains, AI slop flows freely through Google search results like raw sewage, and tech companies keep telling us that this new status quo is not only inevitable, but Good.Standing in stark opposition to these trends is New Session, an online literary zine accessed via the ancient-but-still-functional internet protocol Telnet.Like any other zine, New Session features user-submitted poems, essays, and other text-based art. But the philosophy behind each of its digital pages is anything but orthodox.In the face of right-wing politics, climate change, a forever pandemic, and the ever-present hunger of imperialist capitalism, we have all been forced to adapt, reads the intro to New Sessions third issue, titled Adaptations, which was released earlier this month. Both you and this issue will change with each viewing. Select a story by pressing the key associated with it in the index. Read it again. Come back to it tomorrow. Is it the same? Are you?The digital zine is accessible on the web via a browser-based Telnet client, or if youre a purist like me, via the command line. As the intro promises, each text piece changesadaptsdepending on various conditions, like what time of day you access it or how many times youve viewed it. Some pieces change every few minutes, while others update every time a user looks at it, like gazing at fish inside a digital aquarium.How New Session looks on Telnet. For example, Natasja Kisstemakers Sanctuary changes with every viewing, based on the current weather. Signature, by Kaia Peacock, updates every time you press a key, slowly revealing more of the piece when you type a letter contained in the textlike a word puzzle on Wheel of Fortune.Cara Esten Hurtle, an artist and software engineer based in the Bay Area, co-founded New Session in 2021 along with Lo Ferris, while searching for something to do with her collection of retro computers during the early days of the COVID-19 pandemic.I realized Id been carrying around a lot of old computers, and I thought it would be cool to be able to do modern stuff on these things, Hurtle told 404 Media. I wanted to make something that was broadly usable across every computer that had ever been made. I wanted to be like, yeah, you can run this on a 1991 Thinkpad someone threw away, or you could run it on your modern laptop.If youre of a certain age, you might remember Telnet as a server-based successor to BBS message boards, the latter of which operated by connecting computers directly. It hearkens back to a slower internet age, where youd log in maybe once or twice a day to read whats new. Technically, Telnet predates the internet itself, originally developed as a networked teletype system in the late 60s for the internets military precursor, the ARPAnet. Years later, it was officially adopted as one of the earliest internet protocols, and today it remains the oldest application protocol still in usethough mainly by enthusiasts like Hurtle.New Session intentionally embraces this slower pace, making it more like light-interactive fiction than a computer game. I want people to come back to it because theyre interested in the stories in the same way youd come back to a booknot to get your streak on Duolingo.I wont go into too much detail, because discovering how the pieces change is kind of the whole point. But on the whole, reading New Session feels akin to a palette cleanser after a long TikTok binge. Its very design evokes the polar opposite of the hyper-consumerist mindset that brought us infinite scrolls and algorithmic surveillance. The fact that you literally cant consume it all in one session forces readers to engage with the material more slowly and meaningfully, piquing curiosity and exercising intuition.At the same time, the zine isnt meant to be a nostalgic throwback to simpler times. New Session specifically solicits works from queer and trans writers and artists, as a way to reclaim a part of internet history that was credited almost entirely to white straight men. But Hurtle says revisiting things like Telnet can also be a way to explore paths not taken, and re-assess ideas that were left in the dustbin of history.You have to avoid the temptation to nostalgize, because thats really dangerous and it just turns you into a conservative boomer, laughs Hurtle. But we can imagine what aspects of this we can take and claim for our own. We can use it as a window to understand whats broken about the current state of the internet. You just cant retreat to it.Projects like New Session make a lot of sense in a time when more people are looking backward to earlier iterations of the internetnot to see where it all went wrong, but to excavate old ideas that could have shaped it in a radically different way, and perhaps still can. Heres why we shouldnt lose hope.Last week, the Supreme Court of the United States (SCOTUS) ruled to uphold Tennessees gender-affirming care ban for youth in US v. Skrmetti. The decision confirms what was becoming increasingly clear: that SCOTUS is now little more than a political tool. The result of this case is an appalling decision that will absolutely cost lives. While there might be reason for hope in the long term, the immediate ramifications are going to be dire as were already seeing clinics begin to preemptively cancel appointments based on the decision.Republicans have worked hard to make trans people a divisive issue, and SCOTUS showed that theyre happy to be a part of that. The Skrmetti case was decided on a 6-3 split. While the court is supposed to be apolitical, the decision was entirely split according to which partys president appointed each of the nine justices. Its not unusual for this sort of thing to happen (and outside of the court the justices havent been hiding their political connections well), but this decision flies in the face of science and understanding when we have all the relevant data ready to review. Its hard not to see Trumps hand in the Skrmetti decision. Between his campaign and his executive orders, he has made it no mystery where he and his administration stands on trans peoples rights to life, liberty, and healthcare. Trump, of course, got to handpick three of those justices during his last term. Thats compounded by Trump and his cabinet suggesting they plan to continue to ignore the courts, perhaps even SCOTUS, and Trumps Big Beautiful [Spending] Bill threatens to attack the power of the judicial branch substantially.Crucially, SCOTUS Skrmetti decision ignores medical consensus to an insulting degree. All major medical associations in the U.S. recognize and support gender-affirming care for adults and youth alike. Gender-affirming care is often considered life-saving care, as studies show a staggering drop in suicidal ideation and attempts after treatment.There are always concerns raised (often disingenuously) about detransition rates, satisfaction, and potential harm. But those apparent concerns dont take into account all of the science and research that has been done on the subject that led medical experts to reach their conclusions. Weve recently received the results of yet another survey that once again shows most recipients of the care are satisfied with it, and that the very few people who do detransition do so because of social pressure and transphobia, not because of the care itself or dissatisfaction with the results.But even ignoring the fact that the science supports gender-affirming care for trans youth, the reasoning that the court gave for upholding its ban is still spurious. Chief Justice John Roberts suggested that the decision was based on the fact that the ban, Tennessees S.B.1 , does not violate the Equal Protection Clause as it was not targeting protected classes based on sex or transgender identity, but rather removes one set of diagnoses gender dysphoria, gender identity disorder, and gender incongruence from the range of treatable conditions. Justice Sonia Sotomayors dissent suggested that that decision obfuscates a sex classification that is plain on the face of this statute. That seems particularly apt, given that under Tennessees S.B. 1, cisgender patients, including minors, can still access gender-affirming care such as puberty blockers for those with precocious puberty and top surgery for gynecomastia, the name for enlarged breast tissue on cis men, which is generally removed to treat gender dysphoria in those cis men and teens.Its important to note that the overwhelming majority of gender-affirming care is provided to cisgender people in such situations, and none of the bans seek to limit that care or express the same safety or irreversibility concerns for cis people, even explicitly carving out exceptions for cisgender children in some youth care bans. Its also worth knowing that the targeting of gender dysphoria as presented by trans people as a diagnosis, rather than transgender status, is part of the same tactic that is employed by the Trump administrations trans military ban, which went into effect this month.Even with Roberts claiming that this is about dysphoria as a symptom and not the people with those symptoms part of the court was happy to say the quiet part out loud. Justice Amy Coney Barrett and Justice Clarence Thomas wrote a concurring opinion that suggested that targeting trans people was perfectly fine.Barretts words push against protections for trans people, suggesting that they shouldnt be considered a class because the boundaries of the group are not defined by an easily ascertainable characteristic that is fixed and consistent across the group. In that opinion, Barrett and Thomas are taking an already devastating decision and showing willingness to attack trans people further. The Supreme Court of the United States clearly arent operating in good faith in this case. With all the information and data that was provided to them from the ACLU and in amicus briefs (including one headed by Elliot Page and Nicole Maines), the right decision was clear. But instead, the court went with the political winds of their foundational parties and seems content to be another tool of the executive branch.While all of this is terrible, its good to remember that there is still hope for the future. Chase Strangio, Co-Director of the ACLUs LGBT & HIV Project, who gave oral arguments in the case remains optimistic: it does not mean that transgender people and our allies are left with no options to defend our freedom, our health care, or our lives. The Court left undisturbed Supreme Court and lower court precedent that other examples of discrimination against transgender people are unlawful.I recently spoke with James Esseks, who is also a Co-Director of the ACLUs LGBT & HIV Project, and he made an important point about our history with SCOTUS rulings and how, despite how dark it can seem in the moment, were trending towards the light. In 1986, Esseks highlights, there was a case called Bowers v. Hardwick about whether a Georgia ban on same-sex intimacy was constitutional. SCOTUS ruled 5-4 that the ban was constitutional. And that obviously was a terrible setback for our communitys civil rights. And we didnt give up, right? The community, we picked ourselves up and we figured out ways to move forward.And, it took a while, but 17 years later, we had gotten rid of a bunch of the remaining state laws, and then we got a US Supreme Court decision in a case called Lawrence v. Texas that said, actually, all of those laws were constitutional.I point this stuff out just to say our community has had big successes in the Supreme Court and devastating losses in the Supreme Court, Esseks said. Thats happened in our past, it will probably happen in our future, both good and bad, and we collectively are resilient, and we will find ways forward no matter what happens in the future.Of course, for many of us, waiting 17 years for a fresh gender-affirming care ruling isnt really a solution. We have to remember how to support our community, in particular our trans youth. This one court case doesnt mean that all trans youth in America are doomed, and pretending it does will make for a bleaker world and increased risk. Trans youth suicide rates have been shown to be decreased by many things as simple as the support of at least one trusted adult, more if thats a parent. We have to do whatever we can to help parents of trans kids understand how critical they are in keeping their kids mental health at a level that can weather this and support them in that. She responded that she is now perceiving the interview as more of an attack piece on me.I think its absolute bullsh*t, and I am going to completely reject it. Im warning you right now, youre going to be spreading lies about me, youre putting out a complete narrative about me that is not true, and Im warning you not to do this. She emphasized her support for the president and said, Im also my own person with my own opinion, and I can speak out and say I am against being involved in foreign wars. Theres nothing wrong with me saying that Im against this Its okay for me to say things like that, and this is America, where were allowed to have different opinions. The reporter then asked if she had spoken with the president directly about Iran. Greene somehow interpreted this as confrontational. I dont have to answer any more of your questions because I am sick and tired of your narrative, and Im calling it out as complete and total bullsh*t. So were done. At that, she hung up the phone. The reporters narrative seemed merely to be that Greene had publicly spoken out against the presidents strikes in Iran, and he wanted to know more. Greenes interpretation of the interview as hostile seems completely off base from what the video depicts, though her decision to post it means she fully stands by the claim. The flowerbed was meant to be displayed through June for the citys Pride Month festivities.The flowerbed, situated near the citys Titanic Memorial Bandstand commemorating the musicians lost in the Titanic shipwreck of 1912, was vandalized sometime during the early morning hours of June 23. Photos from The Star Observer showed that someone had torn up the flowerbed, ruining its rainbow flag design. Related A vandal ripped down 10 neighbors Pride flags. Now the locals are fighting back. Camera footage caught the vandal. But the neighbors have responded in a surprising way. Most people in the furry fandom condemn bestiality and anything resembling it, but payment processorswhich have increasingly dictated strict rules for adult sexual content for yearsseemingly dont know the difference and are making it creators problem.The changes include new policies that ban chatbots or image generators that respond to user prompts, content featuring alcohol, cannabis or other intoxicating substances, and selling access to Snapchat content or other social media platforms if it violates their terms of service.Under a section called policy clarifications in an email announcing the changes, Fansly wrote:Anthropomorphic Content - Our payment processing partners classify some anthropomorphic content as simulated bestiality. As a general guideline, Kemonomimi (human-like characters with animal ears/tails) is permitted, but full fursonas, Kemono, and scalie content are prohibited in adult contexts.Hypnosis/Mind Control - This prohibition includes all synonymous terms (mesmerize, mindfuck, mindcontrol, hypno) regardless of context.Wrestling Content - Professional, studio-produced adult wrestling is permitted. Amateur or party wrestling content is prohibited as it may be interpreted as non-consensual activity. Even when consensual, content that simulates force, struggle, or non-consent violates our policies.Public Spaces & Recording Locations - Sexual activity is prohibited in all public spaces. Nudity is prohibited in public spaces where it's not legally permitted. Both nudity and sexual activity are prohibited on third-party private property without owner permission or in any location visible to the public.If creators fall into one of these impacted niches, Fansly wrote in the email, theyll need to review and remove any content thats against the updated terms of service by June 28. In Brooklyn, a man posed as an immigration officer before attempting to rape a woman.ICE claims that assaults against its officers have increased by 413 percent, and use this as the justification for covering their faces. But as Philip Bump showed in the Washington Post there are still plenty of questions about those numbers and their accuracy. WWW.404MEDIA.COJudge Rules Training AI on Authors' Books Is Legal But Pirating Them Is NotA federal judge in California ruled Monday that Anthropic likely violated copyright law when it pirated authors books to create a giant dataset and "forever" library but that training its AI on those books without authors' permission constitutes transformative fair use under copyright law. The complex decision is one of the first of its kind in a series of high-profile copyright lawsuits brought by authors and artists against AI companies, and its largely a very bad decision for authors, artists, writers, and web developers.This case, in which authors Andrea Bartz, Charles Graeber, and Kirk Wallace Johnson sued Anthropic, maker of the Claude family of large language models, is one of dozens of high-profile lawsuits brought against AI giants. The authors sued Anthropic because the company scraped full copies of their books for the purposes of training their AI models from a now-notorious dataset called Books3, as well as from the piracy websites LibGen and Pirate Library Mirror (PiLiMi). The suit also claims that Anthropic bought used physical copies of books and scanned them for the purposes of training AI."From the start, Anthropic had many places from which it could have purchased books, but it preferred to steal them to avoid legal/practice/business slog, as cofounder and chief executive officer Dario Amodei put it. So, in January or February 2021, another Anthropic cofounder, Ben Mann, downloaded Books3, an online library of 196,640 books that he knew had been assembled from unauthorized copies of copyrighted books that is, pirated," William Alsup, a federal judge for the Northern District of California, wrote in his decision Monday. "Anthropics next pirated acquisitions involved downloading distributed, reshared copies of other pirate libraries. In June 2021, Mann downloaded in this way at least five million copies of books from Library Genesis, or LibGen, which he knew had been pirated. And, in July 2022, Anthropic likewise downloaded at least two million copies of books from the Pirate Library Mirror, or PiLiMi, which Anthropic knew had been pirated."Notably, Anthropic also created an internal, general-purpose library made up partially of pirated copyrighted works for various uses for which the company might have of them, in addition to scraping the books for the purposes of training AI. William Alsup, a federal judge for the Northern District of California, wrote in his decision Monday that the creation of this pirated library points against fair use and must be considered at trial. At a hearing in May, Alsup signaled that he was leaning toward making this type of decision: Im inclined to say they did violate the Copyright Act but the subsequent uses were fair use, Alsup said.The downloaded pirated copies used to build a central library were not justified by a fair use. Every factor points against fair use," Alsup wrote. "Anthropic employees said copies of works (pirated ones, too) would be retained forever for general purpose even after Anthropic determined they would never be used for training LLMs. A separate justification was required for each use. None is even offered here except for Anthropics pocketbook and convenience.We will have a trial on the pirated copies used to create Anthropics central library and the resulting damages, actual or statutory (including for willfulness). That Anthropic later bought a copy of a book it earlier stole off the internet will not absolve it of liability for the theft but it may affect the extent of statutory damages.Still, this is not a good decision for authors, because the judge ruled that actually training AI on the works was not illegal, though it is too early to say exactly what this means in a larger context. At the moment, it suggests that training an AI on legally purchased works is sufficiently transformative, but that pirating those works in the first place is not. This case did not consider what it means for AI training of free-to-access content on the open web, on social media, from libraries, etc.Its largely a win for AI companies, who, when faced with these sorts of lawsuits, have almost universally said that their data scraping and training is legal as a transformative fair use under copyright law, arguing they do not need to ask for permission or provide compensation when they scrape the internet to build AI tools.This lawsuit does not allege that Anthropic or Claude directly recreated parts of the authors books to its users: When each LLM was put into a public-facing version of Claude, it was complemented by other software that filtered user inputs to the LLM and filtered outputs from the LLM back to the user, Alsup wrote in his order. As a result, Authors do not allege that any infringing copy of their works was or would ever be provided to users by the Claude service. Yes, Claude could help less capable writers create works as well-written as Authors and competing in the same categories. But Claude created no exact copy, nor any substantial knock-off. Nothing traceable to Authors works. Such allegations are simply not part of plaintiffs amended complaint, nor in our record.Many other copyright lawsuits against AI companies argue that not only are AI companies training on pirated copyrighted data, but that the AI tools they create then regurgitate large passages of those copyrighted works either verbatim or in a substantially similar style. Researchers found, for example, that Metas AI has memorized huge portions of books and will regurgitate them. This case largely considered whether the actual training itself is a violation of copyright law.The use of the books at issue to train Claude and its precursors was exceedingly transformative and was a fair use under Section 107 of the Copyright Act, Alsup wrote in his order. And, the digitization of the books purchased in print form by Anthropic was also a fair use but not for the same reason as applies to the training copies. Instead, it was a fair use because all Anthropic did was replace the print copies it had purchased for its central library with more convenient space-saving and searchable digital copies for its central library without adding new copies, creating new works, or redistributing existing copies.In February, Thompson Reuters won a case against a competitor in which it claimed its competitor illegally scraped its works to train AI. While Amandas marriage had legally taken place in Gwinnett County, Georgia, in 2007, the state refused to recognize the marriage for the purpose of a divorce.In the eyes of the law, the problem was that Amandas wife had transitioned in the intervening years, making the relationship a same-sex marriage in a state where that wasnt legal. Her ex-wife, Gillian (whose name has been changed), had to leave the call early but was happy for Amanda to share the story. We got married young, and we grew together, and at the time she realized that she wanted to be a she, I put her through girl boot camp. And then we realized that we were better off as friends than as partners, but we were together for a total of seven years.The pair got married in Georgia in 2007 and then moved to South Carolina. It was there that Gillian began transitioning, eventually meeting South Carolinas late-2000s requirements to update the gender marker on her IDs. Over the years, people have often jumped to the conclusion that Gillians transition was a driving force in their separation, but Amanda makes it very clear that this was not the case. It came down to Gillians interest in being poly that brought things to an end.Amanda piqued the lawyers interest by pointing out that if you can get divorced, you can get married.The two remained close friends, and when they first separated, Amanda returned to Gwinnett, Georgia. Even finding a divorce attorney for their case at the time proved to be a challenge. Some lawyers avoided the case because of the complexities they anticipated, while others actually used an anti-trans slur while rejecting Amanda as a client.Eventually, they found an LGBTQ+ rights lawyer through the ACLU, though she had never encountered a case like this before. The ACLU rarely gets involved in divorce cases, which often dont create law. Amanda piqued the lawyers interest by pointing out that if you can get divorced, you can get married. Make it work When Amanda approached the state for a divorce, they claimed that she wasnt married because same-sex marriage was not legal in Georgia. Amanda was happy to prove them wrong: Oh, but we were, she told officials. Heres all my receipts. The state then stalled on a response for months.After acknowledging the marriage was legal, the state directed them to get an annulment instead of a divorce, saying that Gillian had lied about her gender to marry Amanda, and thus the marriage was entered into under false pretenses. But Gillians original birth certificate and comprehensive documentation of her transition timeline contradicted that narrative, and Amanda was unwilling to agree to an annulment that placed unjust blame on Gillian.Ultimately, rather than approach the divorce filing with an acknowledgement of the gender transition, the attorney decided that the simplest way was to file as if Gillian had only had a name change. Usually, in a no-contest, no-fault divorce, a couple can simply file the paperwork, pay the fees, a notary signs it, and they get on with their lives. However, a month after filing, Amanda and Gillian received notices that they needed to come to court and meet in front of a judge to receive their divorce.The first time they went to court, they stood before Superior Court of Gwinnett Judicial Circuit Judge Deborah Turner. The judge seemed surprised and confused by the case and proceeded to ask some very invasive questions, as everyone does. Turner asked Amanda why she had originally stayed with Gillian after her transition, and Amanda snapped, Because your honor, I fell in love with a human being, a person, not a penis. And of course, everybody starts laughing, and Im pissed, she recounted.Eventually, Judge Turner said that she wasnt comfortable granting the divorce and passed them along to another judge. That meant waiting for nearly another year. By the time the next hearing came around, nearly two years had elapsed since the initial filing. Amanda and Gillian, both engaged to other people by now, were eager to move on with their lives.I never answered any of the invasive questions, and I told him he could hold me in contempt all he wanted.Amanda Day When they appeared in court again, they stood before Judge Mark Lewis. Instead of asking them to identify themselves, Amanda said Lewis curtly asked, Which one of you is it? And I looked at this man straight back in the face and I go, Your honor, if you cant tell, does it matter? And he goes, I guess its you then.Hes asking some of the most invasive questions about our sex lives, and then he said he was going to hold me in contempt for being difficult and evasive and not answering questions, Amanda said. I never answered any of the invasive questions, and I told him he could hold me in contempt all he wanted.After an hour in divorce court, Lewis called for a lunch break but insisted that Gillian and Amanda return to answer more questions. Amanda called their attorney and was told to keep going in spite of the contempt threats. If he actually held her in contempt, the media would get involved, and the state would not want the attention.Lewis then insisted that the gender change must be the real reason for the divorce, which Amanda disputed. Lewis eventually called Amanda up to the side of the bench and pushed his mic away. Hes like, youre doing this for the ACLU. Youre doing this for fame.Im doing this because I want out of this marriage, but I am not going to throw that young lady right over there whos bawling her eyes out under the bus, Amanda recounted saying. Its not her fault. Finally he goes, Okay, the way your attorney filed it, we can make it work.A powerful divorce While the case ended in that courtroom, the legal minds involved had seen the potential for what their divorce could mean. Before it got to court, their lawyer didnt think the case would get to a point of setting precedent, but did think Amanda in particular might be a good figure for trying to get a case like this to higher courts due to her strong support for Gillians transition. But since the divorce was granted, there was no need for appeals or further escalations of the case to higher courts.Looking back on her divorce over fifteen years after it was first filed, Amanda is mostly just glad that its over. It was a lot of fighting with people asking very inappropriate questions, she reflects. It was one of those situations where I know I lived through it, but sometimes Im like, Wow, I wish that had been somebody else. It took me a long time to process it. Lots of therapy.Today, Obergefell does a lot to allow the trans community to live and love freely. Amanda and Gillians case is a way to understand the hurdles that existed for trans people and their partners before the Obergefell v. Hodges ruling came into effect. But their peculiar story is not a unique case. The ACLUs James Esseks, who served as counsel in Obergefell v. Hodges, Bostock v. Clayton County, and many other landmark LGBTQ+ Supreme Court cases, told LGBTQ Nation that he remembered other cases that came up in the years before the Obergefell ruling.Esseks remembered two cases, one from Kansas and one from Texas, where trans women were married to cis men, which resulted in disputes over the marriages validity. In each of those cases, the husband died, and there was a fight over his assets between the wife and the rest of his family.In both these cases, the courts end up saying, These folks arent married because this is a same-sex relationship, and we dont allow same-sex couples to get married. And, you know, it didnt matter that it was actually a straight couple because they didnt recognize the trans people as who they were. In such cases, as with Amanda and Gillians, that issue completely disappears now that marriage equality is the law. Prior to that ruling, laws affected trans peoples freedom to marry the people they loved, whether it was a same gender or opposite gender pairing. The states policy on same-sex marriage and gender marker updates could prevent some people from going through with a transition or force them to carefully time it around entering or leaving a marriage.Today, Obergefell does a lot to allow the trans community to live and love freely. As Esseks points out, Under the rule of Obergefell, basically, sex doesnt matter in terms of who can get married. That means that complexities that might arise for nonbinary people who have X identifiers on their ID (in states that have allowed that update to birth certificates) are a complete non-issue. Similarly, without Obergefell, the current administrations attacks on trans people and their gender markers could have put marriages in jeopardy and opened up whole new legal questions. In essence, winning marriage equality for LGBTQ+ people was part of a step towards greater acceptance of trans people as part of society. This was particularly evident in an anecdote Esseks shared about a conversation he had with Chase Strangio, a trans lawyer and activist who presented oral arguments in U.S. v. Skrmetti last year.Chase and I were both on the legal team for Jim Obergefell, Esseks recounted. The week after Obergefell gets decided in 2015, Chase went to Rikers Island where he had been doing a series of trainings for the staff about trans folks, just because they had a bunch of trans folks in their jail population. And he came back and hes like, Oh my god, I just had the best training I have ever had. People were the most receptive and open that Ive ever had. And he thought that it was at least in part because of Obergefell.The Supreme Court had just said to people, These are people, gay people are people worthy of dignity in our society.And a whole lot of people are not making a big distinction between the trans folks and the gay folks. Were all just, you know, those queers.
