Gay educator & U.S. citizen detained for hours at border: The definition of psychological terror
The superintendent of a Vermont school district says he was detained by U.S. Customs and Border Protection (CBP) agents while re-entering the country with his husband on Monday, an experience he described as the definition of psychological terror. They falsely stated that I, a U.S. citizen, have no Constitutional rights at a point of entry, and officers became increasingly agitated as I continued to assert my rights regardless, Winooski schools superintendent Wilmer Chavarria wrote in an email to the districts leadership following the incident, according to Seven Days. The independent Vermont news outlet reports that Chavarria, who grew up in Nicaragua but has held U.S. citizenship since 2018, was reentering the U.S. using the expedited Global Entry process at Houstons George Bush Intercontinental Airport following a trip with his husband, Cyrus Dudgeon, to visit family in Nicaragua. Despite having used the pre-approved Global Entry process many times before, CPB agents separated him from Dudgeon and subjected him to five hours of questioning. Dudgeon was not detained. Subscribe to our Newsletter today Agents reportedly refused to allow Chavarria to speak to a lawyer, telling him he did not have the right to legal counsel.According to local CBS affiliate WCAX, agents questioned the sincerity of Chavarria and Dudgeons marriage as well as his employment with the Winooski School District. Chavarria told the station that agents tried to access his computer, which held sensitive student data. He refused to give up his passwords, however, and agents reportedly would not allow him to contact anyone, even when he offered to get in touch with the school district to get permission to turn over his passwords. Chavarria, who was ultimately released and reunited with Dudgeon in Houston, said he did not know why he was detained. However, he noted that he has been very vocal and a big advocate for the protection of vulnerable communities in the state of Vermont and the nation.Im pretty sure Im in a very visible and critical position, and Im not surprised when things like this happen, he told WCAX.In a statement to WCAX, CBP did not specify why Chavarria was detained, saying only that the agency follows strict policies and directives when it comes to searching electronic media. These searches are rare, highly regulated, and have been used in identifying and combating serious crimes, including terrorism, smuggling, human trafficking, and visa fraud. According to both WCAX and Seven Days, Chavarria received an email Tuesday in which CBP informed him that his Global Entry status had been revoked.He also warned that amid the Trump administrations ongoing mass deportations and detention of undocumented immigrants, Rights are being violated for U.S. citizens, as well, and thats going to continue to happen and get worse if people dont mobilize quickly enough.On Tuesday, the Winooski School District board released a statement on Facebook condemning CBPs treatment of Chavarria as deeply disturbing and unacceptable.Superintendent Chavarria is an exemplary leader and a beloved member of the Winooski School District community. His commitment to our students, families, and staff is unwavering. The Board stands firmly in support of him and his family during this time. While we are aware that such detentions are increasingly becoming more common across the country, we must be clear: this is not normal. It is wrong. It is inhumane. He was held and interrogated for hours by CBP agents and given no reason for his detainment.We are talking about a U.S. citizen here. So when we say this can happen to any of us, this is what were talking about. This kind of violation of our constitutional rights is how leaders use terror to intimidate us into silence, Balint continued. When community leaders, school superintendents, are being detained because of the color of their skin and the sound of their last name, we need to hold onto our collective outrage.
