Supreme Court has ruled today that Tennessees ban on gender-affirming care for transgender minors can remain in effect. In a 6-3 decision, the court upheld the law in U.S. v. Skrmetti, dealing a major blow to legal efforts challenging anti-trans legislation nationwide. Chief Justice John Roberts wrote the majority opinion, stating the law does not violate the Equal Protection Clause of the Constitution, reasoning that it differentiates among minors based onage and medical purpose, rather than targeting transgender youth specifically. He emphasized that the Supreme Courts role is not to weigh in on medical opinions or assert the wisdom of such laws, but to ensure that arational basisexists.In a strong dissent, Justice Sonia Sotomayor wrote: Tennessees law expressly classifies on the basis of sex and transgender status, so the Constitution and settled precedent require the Court to subject it to intermediate scrutiny. The majority contorts logic and precedent to say otherwise, inexplicably declaring it must uphold Tennessees categorical ban on lifesaving medical treatment so long as any reasonably conceivable state of facts might justify it.Ante, at 21. Thus, the majority subjects a law that plainly discriminates on the basis of sex to mere rational-basis review. By retreating from meaningful judicial review exactly where it matters most, the Court abandons transgender children and their families to political whims. Though this is a painful setback, it does not mean that transgender people and our allies are left with no options to defend our freedom, our health care, or our lives. It didnt happen.Perhaps the most common argument against legalizing same-sex marriage in the 2000s and 2010s was the barnyard. The OG of slippery slope arguments, the reasoning (using that word generously) was that letting two ladies or two dudes marry would mean that the government would have to let anyone marry anyone else, because reasons. That meant people would marry cats, dogs, donkeys really any animal. Related Major evangelical predicted that marriage equality would cause fathers to marry their daughters Two decades ago, people believed that marriage equality would erase all taboos around sexuality. It didnt happen. In 2013, Rep. Louie Gohmert (R-TX) said that there is no clear place to draw a line once you eliminate the traditional marriage, so the government would have no choice but to acquiesce to somebody [who] has a love for an animal. Gohmert is still in the House today. Rightwing commentator and serial sexual harasser Bill OReilly didnt narrow it down to any species; same-sex marriage rights would ultimately allow for a person to marry a goat, duck, or dolphin. He also talked about marrying turtles on that 2009 broadcast.Sen. John Cornyn (R-TX) brought up box turtles in a draft of a 2004 Heritage Foundation speech, even though he later didnt include the reference. Cornyn is still in the Senate, and Heritage is still providing ideas for administration policy. In 2004, the current speaker of the House of Representatives, Mike Johnson (R-LA), said that marriage equality would inevitably lead to allowing a person to marry his pet.It was so prevalent that I remember a column being written by a more moderate Republican in a major newspaper telling her fellow conservatives to knock it off, that bringing up marriages with horses and starfish was making conservatives look silly. (Mercifully, perhaps, I cant find this column today to link.)Needless to say, human-animal marriage didnt happen. There are no states that started giving gay couples marriage licenses and then realized that theres no logical reason to deny marriage licenses to cats and dogs. There are no states considering legislation to this effect, no one has even introduced a bill in a state to allow human-turtle marriages, and there arent activists pushing for this. There is no way that this prediction could have come true less. In the 10 years since Obergefell v. Hodges legalized marriage equality in all 50 states, it hasnt even started to slightly come true anywhere.But it was a clear prediction of the form If X happens, then Y will happen, and lots of people were making it. So why would they say this? Why would they just lie?One reason would be to induce feelings of disgust. There is no logical policy reason to prevent same-sex couples from getting married, and all the arguments made against marriage equality were created in bad faith. For either religious or hate-based reasons, conservatives didnt like the idea of two men or two women marrying, so they made up concerns about divorce or fraudulent marriage in an attempt to convince others to agree with them. So instead of creating a reason out of thin air, they chose to communicate and reify disgust. Conservatives like Johnson and Cornyn thought that gay people are gross, and sex with animals is something that almost everyone thinks is gross. They linked the two to make people think that gays are just as gross as people who have sex with animals.They presented their argument as a prediction of what would happen because that was the rhetorical form demanded by their need to argue against marriage equality. But they knew it would never happen. Cornyn and Johnson, specifically, are both lawyers and legislators, and both of them knew that no court or legislature would ever allow contracts to be made between humans and animals.This is perhaps one of the reasons so many LGBTQ+ people today find themselves on the left. While gay conservatives will often call other LGBTQ+ people single-issue voters, its more than that. Trump lawsuit that blocks the Trump administration from limiting passport gender marker changes for transgender and nonbinary Americans.The lawsuit began in early February, shortly after the State Department began enforcing a rule requiring that gender markers on passports reflect a persons sex assigned at birth, in compliance with an executive order issued the day Donald Trump took office earlier this year. The executive order demanded that all federal agencies deny the existence of transgender people. The ACLU filed the lawsuit on behalf of their plaintiffs, including social media influencer Zaya Perysian and Ash Orr of Advocates for Trans Equality, who the case is named after. Clayton County,which declared anti-trans job discrimination as a form of sex-based discrimination forbidden by Title VII, because its impossible to discriminate against transgender people without taking sex into account. The ACLU claims that the decision violates their clients First Amendment rights by imposing the presidents ideological beliefs on citizens, the Equal Protection Clause by discriminating against their clients based on sex, and the Administrative Procedures Act by failing to provide advance notice about important changes to government forms.In late April, the judge in this lawsuit ruled that Trumps executive order is likely unconstitutional and ordered the State Department to issue passports with accurate gender markers to each of the individual plaintiffs. Tuesdays ruling from Judge Julia Kobick grants class certification in the lawsuit challenging Rubios anti-trans policy. The Biden-appointed judge also expanded the preliminary injunction to the whole class, meaning the State Department is forbidden from enforcing the policy and will have to issue passports with the correct gender markers for trans people and an X gender marker for nonbinary people who apply for it.This decision is a critical victory against discrimination and for equal justice under the law, said Li Nowlin-Sohl of the ACLUs LGBTQ & HIV Project. But its also a historic win in the fight against this administrations efforts to drive transgender people out of public life. The State Departments policy is a baseless barrier for transgender, nonbinary, and intersex Americans and denies them the dignity we all deserve.
