Military families sue the Trump administration for blocking trans health care
Three servicemembers and their families are suing the Pentagon over a Trump administration policy that blocks military clinics and hospitals from providing gender-affirming care to dependents.This is a sweeping reversal of military health policy and a betrayal of military families who have sacrificed for our country, said Sarah Austin, staff attorney at GLAD Law. However, in January, President Donald Trump directed the Department of Defense to end that care, barring military hospitals and TRICARE from covering it and forcing families to pay out of pocket.When a servicemember is deployed and focused on the mission, they deserve to know their family is taken care of, Austin said in a statement. Subscribe to our Newsletter today In February, Secretary of Defense Pete Hegseth implemented a rule prohibiting transgender service members from receiving gender-affirming care and barring new enlistments of those with a history of gender dysphoria. A federal court temporarily blocked the rule in April, finding the restrictions unconstitutional. Despite this ruling, Assistant Secretary of Defense for Health Affairs Dr. Stephen Ferrara chose in May to enforce the policy.The three families that are challenging the Pentagon are arguing that the administrations actions exceed the scope of last years law, which bars TRICARE from coveringmedical interventions for the treatment of gender dysphoria that could result in sterilization. The lawsuit also contends that Trumps executive order and the Pentagons enforcement, which restrict care for all dependents, violate a separate statute prohibiting federal regulations from being arbitrary and capricious. According to the lawsuit, two of the childrenidentified as Diana Doe and Nathan Noehad been receiving hormone therapy with their parents consent, based on guidance from doctors at Walter Reed National Military Medical Center in Maryland. This spring, their doctors informed the families that the medical center could no longer provide the therapy, and TRICARE sent no notice of the coverage change. The third plaintiff, Parker Poe, a young adult, has been unable to continue treatment after his doctor at an unnamed facility told the family that TRICARE would no longer cover his testosterone or related care.President Trump has illegally overstepped his authority by abruptly cutting off necessary medical care for military families, said Shannon Minter, legal director at the National Center for LGBTQ Rights (NCLR).
