(AP Photo/Erin Hooley)2026-02-10T13:45:27Z NEW YORK (AP) Shoppers unexpectedly paused their spending in December from November, closing out the holiday shopping season and the year on a lackluster tone.The report, issued by the Commerce Department on Tuesday, surprised economists who were looking for growth despite mounting concerns about slowing job growth, uncertainty about President Donald Trumps tariffs and other economic headwinds. And it raised questions about shoppers ability to spend after they have remained resilient for months despite souring consumer confidence, economists said.Retail sales were flat in December from November, when business was up 0.6%, according to the Commerce Department. Economists were expecting a 0.4% increase for December. The report was delayed because of the 43-day government shutdown.Sales in October fell 0.1%, rose 0.1% in September, but jumped 0.6% in July and August and 1% in June, according to the Commerce Department. The retail sales figures, which are not adjusted for inflation, showed that many types of businesses posted declines including furniture and home furnishings stores and electronics and appliance retailers. Among the few bright spots: building materials and garden stores, which posted a solid sales increase. Gas stations and food and beverage stores saw small sales gains.The snapshot offers only a partial look at consumer spending and doesnt include many services, including travel and hotel lodges. But the lone services category restaurants registered a dip of 0.1%. The data comes as U.S. consumer confidence has been souring for months. In fact, confidence declined sharply in January, hitting the lowest level since 2014 as Americans grow increasingly concerned about their financial prospects. Consumer spending has finally caught up with consumer sentiment, and not in a good way, Chris Zaccarelli, chief investment officer for Northlight Asset Management in Charlotte, North Carolina, wrote in a report published Tuesday. He noted that consumer confidence numbers have been disappointing for months, and shoppers have been complaining about the cost of everything and yet they kept spending. But he added, This months data show that consumers are no longer relentlessly increasing their level of spending.Thomas Ryan, North America economist at Capital Economics, also noted the report was worrisome, but given expected stimulus from the bigger tax refund checks, he thinks that consumption at the end of the first quarter of this year may turn out to be a lot stronger than it currently looks at the start.Economists will be closely monitoring a slew of economic reports on jobs and prices due out later this week.But the economy is in a confusing place. Growth is robust: Gross domestic product the nations output of goods and services advanced from July through September at the fastest pace in two years. But the job market is lackluster: Employers have added just 28,000 jobs a month since December.In the 2021-2023 hiring boom that followed COVID-19 lockdowns, by contrast, they were creating 400,000 jobs a month. When the agency releases hiring and unemployment numbers for January on Wednesday, they are expected to show that businesses, government agencies and nonprofits added about 80,000 jobs last month modest but up from 50,000 in December.Analysts will also be studying consumer price report, to be released Friday. In December, consumer prices matched the 0.3% increase in November. If inflation cools in the coming months, it could increase the likelihood the Federal Reserve will reduce its key interest rate later this year, economists say.Against this backdrop, some chains like Walmart, whose everyday low prices have pulled in shoppers from rivals, are thriving but others struggle.A growing number of retailers are closing stores as companies reorganize under bankruptcy protection or pare down their operations to focus on profitable operations.On Monday, the operator of roughly 180 Eddie Bauer stores across the U.S. and Canada filed for Chapter 11 bankruptcy protection, blaming declining sales and a litany of other industry headwinds. Last month, the parent company of Saks Fifth Avenue said it was seeking bankruptcy protection, buffeted by rising competition and the massive debt it took on to buy its rival in the luxury sector, Neiman Marcus, just over a year ago. A few days later, the parent company said it was closing most of its Saks Off 5th stores.Amazon said earlier this month that it was closing almost all of its Amazon Go and Amazon Fresh locations within days as it narrows its focus on food delivery and its grocery chain, Whole Foods Market.     Marc Benioff 'Jokes' ICE Is Watching Salesforce Employees Who Traveled to the U.S.
    Salesforce CEO Marc Benioff joked with employees who had traveled to the United States for a Salesforce all-hands meeting that Immigration and Customs Enforcement agents were in the building keeping tabs on them, 404 Media has learned.Multiple employees told 404 Media about the joke, and 404 Media obtained internal Slack chats showing employees discussing it. Benioff was giving the opening keynote at the Salesforce CKO event in Las Vegas on Tuesday, which is a major Salesforce meeting kicking off its strategy for the year. In his keynote, Benioff thanked international employees for traveling to the United States for the meeting, and asked them to stand. Benioff then said that ICE agents were in the building to keep tabs on them.The comments instantly became a major topic of conversation on Saleforces internal Slack, with shocked employees trying to figure out if they had misheard the CEO. One employee asked what was the ice joke? Another employee responded If youre visiting from outside the United States, please stand ICE is keeping track of that. Another said the joke was Please stand if you traveled here from abroad! Thank you! Just so the ICE agents know. And a third wrote that the joke was, roughly, Please everyone stand who traveled here internationally. And then while they are still standing, there are ICE agents in the hall to keep tabs on you.The room groaned, one employee wrote on Slack. Employees are going absolutely apeshit in internal Slack about how completely awful it was. Another employee told 404 Media that Benioff then followed it up with a joke about not understanding the message of Bad Bunny's Super Bowl performance. On its own just seems out of touch, but coupled with the previous joke it does seem worse.In a Slack channel called #airing-of-grievances, employees posted a meme of a Nazi officer that read Are we the baddies? Another wrote Serious question: would a statement of apology/recognition/whatever by someone (anyone) actually do anything at this point? Or has a rubicon of sorts been crossed? A third wrote Its super uncomfortable to me that this has been glossed over like ZERO mention of hey we hear your comments and your voice matters.Another employee created an ICE OUT emoji and noted that it was a low impact probably fluffy mini protest but I made this emoji for my status so its abundantly clear that I do not endorse or align with the values being joked about at this company. More than 150 employees reacted to the message with the emoji. Another employee wrote I literally thought I was hallucinating or misread what came out of his mouth. Disbelief and disappointmentis this how we model humanistic compassion as a world-class company? Stop talking about money and profit for a minute, ffs.Other employees shared links to donate to causes protecting immigrants, and another wrote I cant believe that the man that faced down Governor Mike Pence in the name of equality just made ICE jokes after asking international employees to stand up.ICE, of course, has been violently detaining and deporting undocumented immigrants across the United States. But there have also been many high-profile cases of people simply visiting the United States on tourist visas or for short-term stays being detained because of minor clerical issues or things that they had posted on their social media.In October, Salesforce told ICE that it would be willing to allow the agency to use its AI to hire, and said the company was well-placed to help ICE to nearly triple its work force by hiring 10,000 new officers and agents expeditiously.Salesforce did not immediately respond to a request for comment.

The Supreme Court press office did not respond to a request for comment.On Dec. 31, 2025, the center released the first update in 15 years of its 1,682-page peer-reviewed guide, called the Reference Manual on Scientific Evidence, including more than 90 pages defining climate terminology and describing the state of scientific consensus on climate change and the methods used to attribute specific weather events to climate warming and its causes. The chapter acknowledges uncertainty in some areas of climate science; it generally reflects the conclusions of the U.N.s Intergovernmental Panel on Climate Change.The manual, widely cited and relied upon by law clerks and justices, is produced in partnership with the National Academies of Sciences, Engineering and Medicine and also includes chapters on artificial intelligence, DNA identification and epidemiology, among other subjects. It is considered among the most important and trusted guides for justices grappling with technical material, in large part because it is endorsed by the judicial branch itself.Its publication of the chapter on climate change, however, drew immediate criticism from conservatives, who allege that the section is slanted against oil and gas producers and represents an effort by activists to sway the opinion of judges deliberating on current cases.The withdrawal comes as a number of lawsuits seek to hold oil and gas companies accountable for the damage caused by climate change, which has been scientifically linked to the emissions produced by burning fossil fuels. Republican attorneys general have repeatedly criticized these lawsuits, accusing liberal groups of using tort law to enact regulatory policy and supporting efforts to have cases dismissed or moved into federal court.On Feb. 2, more than 20 Republican attorneys general wrote to the House and Senate judiciary committees stating that the manual is tainted by biased authors, reviewers, and sources involved in ongoing litigation, and that it is an inappropriate attempt to rig case outcomes in favor of one side. The group encouraged the House Judiciary Committee, chaired by Ohio Republican Jim Jordan, to include the publication in a recently announced investigation into a program by the Environmental Law Institute, a nonpartisan research group, to educate justices on climate change.The next day, the Federalist Society, a conservative judicial organization, convened a panel to discuss the publication of the manual. The moderator said it runs counter to the Federal Judicial Centers role as a neutral arbiter of fact and warned that the inclusion of a climate science section advances an ideological agenda.The chapter reflects an assumption that certain bodies of evidence are automatically more credible than others, Michael Williams, West Virginias solicitor general, told the panels audience. It suggests certain questions are resolved when theyre actually still being litigated before courts.On Feb. 6, the director of the Federal Judicial Center, Judge Robin Rosenberg of the Southern District of Florida, wrote to West Virginia Attorney General John McCuskey that the center has omitted the climate science chapter.In their letter last week, the attorneys general raised concerns that one of the authors of the climate chapter is employed by the Sabin Center for Climate Change Law at Columbia University and that in the footnotes of the report the authors thank the executive director of that program, Michael Burger. Burger, who declined to comment, is of counsel to the law firm Sher Edling, which represents several of the plaintiffs in the climate cases, including the city of Honolulu.The objections by the state attorneys general represent a bad-faith critique that is ultimately aimed at repressing scientific information, Jessica Wentz, one of the chapters authors, said. The withdrawal of the chapter, she said, is going to be used to advance this narrative that there is a debate about even the most fundamental aspects of climate change.Wentz said that she has never been a witness or served as counsel in any climate litigation and that it is disingenuous for the attorneys general to object to the material in the climate chapter which acknowledges the consensus that human activity is responsible for warming because it is the subject of contested litigation. None of the major climate lawsuits that she is aware of debate the science of warming and instead address questions about fossil fuel companies responsibility. The infusion of bias, Wentz said, comes not from exposure to scientific information but from the suppression of that scientific information.The National Academies of Sciences, Engineering and Medicine has maintained a copy of the original manual on its own website even as the Federal Judicial Center has removed the version with the climate change chapter from its own. (AP Photo/Mike Stewart)2026-02-10T20:02:52Z ATLANTA (AP) The FBI obtained a search warrant to seize hundreds of boxes of ballots from election offices in Fulton County, Georgia, as part of a criminal investigation into possible deficiencies or defects in the vote count in the 2020 contest lost by President Donald Trump, according to an affidavit unsealed Tuesday.The affidavit provides the first public justification for an FBI search last month that targeted a county that Trump and allies have long seen as central to their false claim that the 2020 election was stolen.But the allegations outlined in the affidavit are largely based on claims that have long been made by people who assert that there was fraud in the 2020 election. Audits, state officials, courts and Trumps own former attorney general have rejected the idea that there was widespread fraud in the 2020 election that could have altered the outcome. Among the deficiencies or defects investigators are looking at is Fulton Countys admission that it does not have scanned images of all the ballots counted during the original count or the recount, according to the affidavit. Fulton County has also confirmed that some ballots were scanned multiple times during the recount, the affidavit says. If these deficiencies were the result of intentional action, it would be a violation of federal law regardless of whether the failure to retain records or the deprivation of a fair tabulation of a vote was outcome determinative for any particular election or race, the document says. The affidavit says seizures of the election records was necessary to determine whether election records were destroyed and or the tabulation of votes included materially false votes. It cites potential violations of a law regarding the preservation and retention of election records, a misdemeanor. It also cites a law that makes it a crime to knowingly and willfully deprive residents of a fair and impartially conducted election process, which is a felony.
