    Kim Davis asks Supreme Court to take her case in hopes of bringing down marriage equality
    Former county clerk Kim Davis has asked a second time for the Supreme Court to take her case, with anti-LGBTQ+ advocates hoping it could be the one to lead the justices to overturn marriage equality. Davis, a conservative Christian who has been married four times,refused to provide marriage licenses to gay couples in 2015after the U.S. Supreme Court legalized marriage equality. Davis told the couple (who ultimately sued her) that she was acting under Gods authority when she refused to issue the license because she believes marriage is only between a man and a woman. Anti-LGBTQ+ advocates dont draw many distinctions between fewer people being LGBTQ+ and fewer people feeling safe enough to say that theyre LGBTQ+. She was jailed for five days for contempt for refusing to comply with a court order and has spent the last decade entangled in legal battle with two of the couples she discriminated against. Subscribe to our Newsletter today We are asking the Court to recognize the First Amendment as an absolute defense for Kim Davis and to overturn the 2015 Obergefell opinion, which has no basis in the Constitution, Daviss lawyer, Mat Staver of the anti-LGBTQ+ Liberty Counsel a Southern Poverty Law Center-designated hate group told the Lexington Herald Leader.Staver also claimed Obergefell did significant damage to the historic definition of marriage, to states rights, to religious freedom, and to the rule of law.It is time to end this legal fiction and undo the damage done, he said. According to the Herald Leader, the court request filed by Liberty Counsel on Thursday asks the Court to answer three questions: whether marriage equality should be overturned, whether Davis has qualified immunity that bars her from paying damages to a couple who sued her, and whether requiring her to issue marriage licenses to LGBTQ+ couples was a violation of her religious freedom.Qualified immunity protects government officials from personal liability for violating someones rights, unless they are in violation of clearly established constitutional rights, as the Supreme Court case ofHarlow v. Fitzgeralddecided in 1982. Davis has already been denied qualified immunity multiple times in this case. In the most recent request to the Supreme Court, Staver other Liberty Counsel lawyers echoed the thoughts of Supreme Court Justice Clarence Thomas and argued the decision in Dobbs v. Jackson Womens Health Center that overturned the federal right to an end a pregnancy should serve as precedent in this case.Thomas opened the door to marriage equality being overturned in 2022 when the Supreme Court overturned reproductive rights. In his concurring opinion, he wrote that the same logic that was used to overturn reproductive may be used to overturn marriage equality and access to birth control.The case in question involves David Ermold and David Moore. Last year, Davis was ordered to pay$260,104in fees and expenses to the couples attorneys, and in 2023, she was ordered to pay them $100,000 in damages for violating their constitutional rights. This is the second time Davis has requested the Supreme Court hear the case. The first time was in 2020, and the court declined. Although some on the right believe Davis is the key to ending marriage equality, experts told the Herald-Leader the Court is unlikely to use this case to do so since Daviss actions were blatantly unconstitutional and since the case is so old.Ermold and Moores lawyer, Bill Powell, agreed, saying that not a single judge on the U.S. Court of Appeals showed any interest in Davis rehearing petition, and we are confident the Supreme Court will likewise agree that Davis arguments do not merit further attention.Subscribe to theLGBTQ Nation newsletterand be the first to know about the latest headlines shaping LGBTQ+ communities worldwide.

    'King of Drag's' Perka $exxx says his drag combats 'the horrors in my day-to-day' (exclusive)
    For King Perka $exxx, watching himself on the first season of King of Drag was, in a word, a mindf*ck, but doing the show itself was a great time for the drag king, whose wicked paint and endlessly quotable, hilarious quips quickly made him a fan favorite.It's hard to imagine the season without the Charlotte, South Carolina-based drag star, but that's nearly what happened. I almost quit. I almost didn't go, he reveals. When the drag artist isn't thrilling audiences with his transgressive and political performances, he's a college student with a job working for, like the big evil bad coffee company, and finding a balance between all those priorities almost became too much for Perka. It was a lot, and I couldn't just quit my job...I wanted to make sure I had a life to come back to. So it was difficult trying to prepare while trying to also keep my life together, he recalls.I just had to talk to myself: 'Calm down. It's okay, don't focus on winning. Focus on having fun and having fun making memories, he says. I told myself, as long as I keep having fun, I won. And also, if I didn't win the horror challenge, I was gonna quit drag.Thankfully, he did, with a performance that laid bare both his journey to coming out as a trans man and the trauma of the lack of acceptance from his mother. Its a performance so real and so raw that Perka admits he hasnt been able to watch it. Oh, I can't watch my floor show. It triggers me, he says. When I do scary horror drag, one of the reasons why I like doing it is that if I'm the scary thing, that means I can't get scared, and I can't be scared if I'm the one that's in control and doing the scaring.And nothing is scarier than trauma. People [online] are like, Oh, why didnt they do things like, like spiders or like sharks? he reveals. A shark isn't gonna tell me to drop dead over eating cereal. A shark isn't gonna do that to me.I see on the Reddit comments people [asking] why is Perk so mean to himself? he shares. I'm like, bitch, that's what my mom said to me as an adult, imagine when I was a kid.Theres no shortage of things for Perka to be afraid of living as a Black trans man in the South, something the performer acknowledges. I use horror drag as a way to navigate the horrors that I just face in my day-to-day existence, he explains. I always joke with people kind of joke, kind of not joke...if I want to do something scary and dangerous, I'll just drive past a cop car. If I want to do something that's dangerous, I will just exist at night and walk too close to a white lady, and then that's dangerous for me. I could walk in a neighborhood and not wave to someone, and then that becomes a dangerous situation for me. I could just drive through a really rednecky rural area and see the Confederate flag flying everywhere. I could do that. That's scary for me.What wasn't frightening for the drag star, however, was the dynamic between him and the rest of the cast. The entire time was a bro fest, he says. The cast also helped relieve some of the pressure Perka felt walking into the Man Cave when it came to representing the entire drag king community a feeling that was all too familiar to the king. I feel that pressure every time I do a drag show, I'm like: I'm the first drag king they see, if I fuck up, they will never like drag kings again, he says. Also, just to be real, I was like, if I'm the only Black person, or one of few Black people on this show, I have to [do well]. Then I saw [King] Molasses and Pressure [K]. I'm like, Oh, okay. So, that took a lot of pressure off. Perka, who sits at the crux of a lot of different intersections, was relieved to see how many of them were represented among the cast. Whether that was his fellow POCs, trans folks, campy horror kings, or cat dads, he says. I'm here to honor Black people with no rhythm, he jokes. I just hope my population feels represented.That closeness created in the Man Cave, and at the hotel after filming wrapped each night, forged powerful bonds that continue to this day, but they could also make the eliminations particularly emotionally charged, as when Perka sent his friend and hotel roommate, Buck Wylde, home in the second episode.I felt like shit when I sent Buck home because I felt personally responsible, he recalls, Especially since the night before we went to a park, we were working on our things together.. We're over here talking about our dreams and futures."Perka felt awful, so he ducked into the closet of their shared hotel room to have a private moment. I just started crying, he shares. Making matters worse, he discovered that he couldn't open the door from the inside. I was literally just trapped in the closet, and I was too afraid to ask for help, because I'm like, I don't deserve Buck's help. Eventually, Buck discovered him in the closet and the two had a good laugh. Buck was super supportive, says Perka. The next day, he said, bring back a win for 594, which was our room number, and I brought home the double episode win. It felt good. It felt good to know that Buck didn't go home in vain.Perka certainly left an impression each week, whether it was with his heart-wrenching 'Death of Your Fears' horror challenge, or his hilarious impression of Steve Urkel in 'The Dong Show' challenge. Although, Perka confesses, he really picked the character as an excuse to dress up as Sonic the Hedgehog. If I had to pick between Urkel and Sonic, I would have picked Sonic because I like dressing up as animals in drag, not as another person. That's boring. I'm already a dude. Why would I be another dude? he asks.While he's mostly excited that people have begun to associate him with the videogame character, he wouldnt be mad if news of his performance made it to the actor who famously brought Urkel to life. I just want people to tag Jaleel White in that photo, he says. If they ever do a Family Matters revival, I will be Urkel like I am trans masc. I will look 12 forever. Let's make some money off of it.Still, being on television comes with heightened scrutiny from would-be critics, which Perka shrugs off. Oh, I'm used to people wanting to talk about me because I'm just very interesting, and some people are just petty and boring, he jokes. But it also means being more visible at a time, in a country, where existing as a drag artist, let alone a trans man, can be dangerous. But Perka is keeping it in perspective. You're not gonna find a drag king unless you're looking for a drag king and at that point, why are you looking for drag kings? It's like, it's like the thing of, like, Oh, my God, my uncle saw my gay porn. But wait, why is my uncle looking at my gay porn? he jokes. If Im doing drag and if someone's like, Oh my gosh, I don't want you around my kids. I'm like, Bitch, I don't want to be around your kids. Is little Timmy tipping?That being said, hes already felt some invasion of privacy due to well-meaning fans online creating posts outing him and using his off-stage name. I literally had to make a Reddit account, he reveals. And I was like, Hey, y'all Perka here. I appreciate the sentiment...I understand what you were trying to do. And I did say on the show what my first name is. I did say that I am trans, but the context is that you have to watch the show to find out those things about me." Instead, he jokes, fans should feel free to pass around his Cash App.It's the same reason he gets frustrated when well-meaning fans call for drag kings on other shows, like RuPauls Drag Race. You're advocating for me to be on reality TV where I'm going to spend a lot of money, I'm going to get read to filth by 10-year-olds, and I probably won't even win, he says. Instead of wanting that future for me, why don't you take me to [Applebees] to get a 2 for $20? One of these things is a more immediate reward.While Perka may not be rushing to apply for another reality competition right now, the platform proved to be a great showcase for both his personality and his talent. Hes very grateful for his journey on the hit Revry show. So, would he ever do something similar again? Maybe.I'm glad I did King of Drag first. I'm glad I was around, like, brothers. I was competing with brothers. That made the experience a whole lot better. I wasn't around a bunch of bitchy drag queens. No shade to drag queens, but some of y'all are bitchy, narcissistic bitches, which is why no one wants to date you, he jokes.So, when will we see him on our TVs again? It may be a bit, but not forever. I feel like after a few years, when my non-compete is over and I can get my bank account padded up a little more, I would audition for something else, I would, he shares.While Perka might not have snagged the King of Drag title, one thing is clear: he knows hes won anyway. We all feel like winners already, he explains.     Why the Epstein Files might finally provide consequences Trump cant dodge
    Donald Trump has a superpower: he seems uniquely able to escape consequences and criticism. Despite all the furor around Trump and the Epstein files, it would be easy to cynically sigh and say, Yeah, but this will just slide off his back like everything from the Access Hollywood tape to the January 6th insurrection.While Trump is putting out all the distractions that he can right now, the threat of the Epstein client list continues to loom large. Surprisingly, the heart of that problem for Trump is connected to the anti-trans hate campaign that he has stoked among MAGA Republicans. A group of Republicans who have previously been very loyal to Trump have built a large part of their platform around protecting children. While thats an admirable political position to take, too often, rather than making moves that will lead to real support for children in dangerous situations, it has amounted to an excuse for bigotry and hate targeting the LGBTQ+ community. Subscribe to our Newsletter today While House Representative Marjorie Taylor Greene (R-GA) introduced the Protect Childrens Innocence Act back in 2022, it wasnt about preventing youths from sexual trafficking; it was about making it a felony to provide gender-affirming care. Similarly, Rep. Nancy Mace (R-SC) has yelled about LGBTQ+ people being groomers and suggested that trans people are sexual predators.Trump knows exactly how bad the Epstein files could be for him (even with supporters in his own party), and Trumps usual bag of tricks arent working.While there is no definitive proof available at the moment that Trump is implicated in the Epstein files, there is certainly a lot of smoke. We know that the Trump administration knows how to release classified files, and even how to remove a lot of the information that would actually be of interest to people, as they did with the recently released JFK files (to the disappointment of conspiracy theorists everywhere). The fact that the Epstein files remain unreleased despite Trumps campaign promises feels significant.In the last couple of weeks, two things have become very clear: Trump knows exactly how bad the Epstein files could be for him (even with supporters in his own party), and Trumps usual bag of tricks arent working. His supporters blind loyalty isnt cutting it when it comes to connections with Epsteins Island, and pundits can only go so far in casting revelations (or lack thereof) in a positive light. Thats why Trump has resorted to full damage control mode and is trying to get people to talk about anything other than Epstein.Some of his recent more extreme attempts to deflect attention from Epstein include releasing the MLK files (against the familys wishes), a move that ironically emphasizes that he can release classified files if he wants to. He has taken aim at Obama, accusing him of treason around the 2016 election despite poor evidence. (Its worth noting that, with the Supreme Courts ruling on presidential immunity that favored Trump, its unclear what Trump wants the Department of Justice to do about his Obama treason claims). And perhaps most surprising, Trump has allowed the White House to reveal that he is not the Herculean figure that he has always claimed by admitting to a health condition that is prevalent in older adults.But all of those distractions have been ineffective, with attention quickly returning to Epstein, especially after the Wall Street Journal reported that Attorney General Pam Bondi informed Trump he was in the Epstein Files back in May.Trump is right to be worried. Marjorie Taylor Greene and Nancy Mace both seem to have flipped their support of him over this issue.Of course, with Trump, its still possible that all of this will get pushed away as some conspiracy theory cooked up by the Democrats. Theres still room for those too far invested in the sunk-cost fallacy of Trumpism to work out some double-think explanation for all of this. But a fracture in the Republican party will leave a lot of people asking themselves uncomfortable questions about their continued support for Trump, and it seems like that fracture is here at last.Some toadies are still willing to follow Trumps guidance, like Speaker of the House of Representatives Mike Johnson (R-LA), who, this week, attempted to avoid a vote on releasing the Epstein files by recessing the House early for the summer.But Trump is right to be worried. Marjorie Taylor Greene and Nancy Mace both seem to have flipped their support of him over this issue. Greene was clearly upset when the first announcement dropped that the Epstein files would not be released, and has warned that hell lose his MAGA base if he doesnt come through on this. Both Greene and Mace have been hardline supporters of Trump and huge advocates of the anti-trans movement, and they both seem to be seeing where the wind is blowing as they turn on Trump. Greene, in particular, while wrong-headed about her approach, seems truly committed to her statements about protecting children.Despite Johnsons best efforts, the House Oversight Committee has voted to subpoena Epsteins accomplice, Ghislane Maxwell, and to subpoena the Justice Department for its files on Epstein. That vote saw three of the five Republicans on the 10-person committee side with the Democrats, including Nancy Mace as she distances herself from Trump. With the idea that their president might in fact pose the real harm to children, there will have to be consequences. With the current Congressional margins, it would take a relatively small number of Republicans finding their backbones and consciences for Trumps position to be in real jeopardy and for hearings to pull a lot of secrets into the light. For now, Trump seems to want to obfuscate the facts. He asked Bondi to call for the Florida Grand Jury transcripts from Epsteins trial to be released. Those documents likely arent the ones the public might be expecting, and a judge has already rejected the request.Trump is caught in a catch-22 here: He either finds a way to release the Epstein files without removing the names of people that could be implicated as predators, possibly revealing his own culpability to the world, or he goes back on his promise to release them from the campaign and people assume the worst about his possible involvement with Epsteins crimes. The real problem for him here is that its so easy to believe he might be implicated after so many stories about Trump at teen beauty pageants, his sexual abuse conviction, and the allegations of sexual assault and misconduct levied against him by at least 25 women.It seems clear that something is going to come out of all of this. If reports are to be believed, then Trump will either be present in the files, or hell be conspicuously omitted. There are going to be questions to be answered and it will put a lot of Republicans in a no-win situation: either drop Trump and feel his ire, or be perceived as protecting a child predator while running on a pearl-clutching think of the children platform as a way to attack LGBTQ+ people.It all adds up to one scandal that Trump just might not be able to ignore.Subscribe to theLGBTQ Nation newsletterand be the first to know about the latest headlines shaping LGBTQ+ communities worldwide.

Bush and other conservative Christian politicians consistently called for voucher systems whereby students could choose to attend privateparochialschools at public expense. He supported prayer in public schools as well as at school events. Some religious, governmental, and educational leaders also push for the teaching of Creationism (reframed as Intelligent Design) to explain the genesis of the world and all its inhabitants. Candidates and elected officials don their Christian credentials like armor to repel potential attacks on their motivations and character.The chief architects of the United States Constitution certainly did not have these measures in mind. James Madison, familiarly called the Father of the Constitution, was most responsible for the First Amendment, along with Thomas Jefferson.Virginia was one of the first states to address the issue of religion and government when Thomas Jefferson, a deist, drafted An Act for the Establishment of Religious Freedom in1777. Jeffersons proposal became state law in 1786. Then, constitutional framers such as Jefferson and Madison negotiated a compromise with Protestant sectarians, which led to the clause written into the First Amendment of the United States Constitution: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereofThough nowhere in the U.S. Constitution does the phrase separation of church and state appear, it was originally drawn from a letter President Thomas Jefferson sent on January 1, 1802, to the Danbury Baptists Association.Both Madison and Jefferson held deep concerns over the possibility of an erosion of the First Amendments religious freedoms. He also said a rapist would never bother pretending to be trans since the country actually treats rapists better than trans people. He then brought attention to the massive rise in anti-trans hate crimes in the country, no doubt fueled by the violent rhetoric coming from the GOP. Cumming said anti-trans hate crimes are up 125% in Los Angeles Cumming was referencing data from the 2023 LA County Hate Crime Report, which not only found that anti-trans hate crimes were up 125% but also that 97% of those crimes were violent.And according to GLAADs ALERT Desk Report, hate crimes against trans people in the United States increased 14% between May 2024 and May 2025. Additionally, 52% of all anti-LGBTQ+ hate crimes targeted trans and gender nonconforming people, GLAAD reported.After communicating the dire situation, Cumming then made another jab at the president. Another surprising statistic, our sitting president is a million percent more likely to be on the Epstein list than any trans person, he said.Lets not pretend that weve got our eye on the ball when it comes to sexual violence, okay America? he continued, And how dare this president make random unfounded accusations of sexual criminality against trans people when he was literally ordered to pay $83 million to a woman who accused him of sexual assault. (Last year, a jury in New York City issued an $83.3 million judgment against the president for for repeatedly defaming E. Jean Carroll, the woman he sexually assaulted).Its the pot calling the kettle black after trying to grab its handle in the changing room of a TJ Maxx, Cumming said, adding that Trans people are far more likely to be victims of sexual assault or violence than be the perpetrators.He urged people to be worried about issues that are actually hurting the nation, like a lack of gun control laws. He then asked viewers to imagine what it would be like to be trans in America today.Imagine having to stockpile your essential life-saving medicine because your president might cut off access to it for no other reason than it makes him look strong to his base, he said.Cumming also said that although hes an atheist, he knows Jesus would have loved trans people because he loved all people.
