WWW.404MEDIA.COData Center Tech Lobbyists Fearmonger in Attempt to Retroactively Roll Back Right to Repair LawLobbyists for major tech firms like Cisco and IBM are trying to push through legislation in Colorado that would drastically roll back a groundbreaking right to repair law under the guise of protecting national security and data centers.The legislation, which passed through a Colorado state senate committee on Thursday, would exempt hardware from the existing right to repair law if that hardware is considered critical infrastructure. One of the issues with this is that critical infrastructure is very broadly defined, and could include essentially anything. In practice, the law could essentially repeal huge parts of one of the most important right to repair laws in the United States.It relies on a broad, vague definition that allows the manufacturer themselves to self-designate whether their equipment is for critical infrastructure, Louis Rossmann, a right to repair expert and popular YouTuber, testified at a hearing on the bill Thursday. So if a laptop manufacturer knows the Pentagon buys their laptops, they can declare that line exempt. If a networking company sells a $20 switch to a federal building, they can claim that hardware is critical infrastructure. Its a blank check for manufacturers to exempt themselves.Ever since consumer rights advocates began pushing for right to repair legislation roughly a decade ago, hardware manufacturers have been fear mongering to lawmakers by telling them that right to repair would introduce security threats by requiring them to reveal proprietary information about their products. In practice, the exact opposite has happened, because greater access to repair parts, tools, diagnostic software, and repair guides means that broken equipment that could potentially be more vulnerable to hacking attempts can be fixed more quickly.When we talk about critical infrastructure and fixing things, we often do not have time to wait for an official fix from a company that may not be motivated to fix things, Andrew Brandt, a security researcher and cofounder of the nonprofit Elect More Hackers, testified Thursday. What ends up happening is that with smaller companies, where they may have spent most of their budget buying some firewall or router that they can no longer afford, they end up in a situation where theyre just going to keep running that device in an unsafe state and leave themselves vulnerable to cyber attack.The groups pushing for this legislative rollback appear to be legacy enterprise hardware manufacturers, who highlighted during the hearing the fact that their technology is increasingly being used in data centers, which seem to be one of the only things the current American economy seems capable of building. Lobbyists for the Consumer Technology Association, which represents many large manufacturers, testified in support of the bill, as did Joseph Lee, who works for Cisco.While Cisco appreciates the arguments offered in favor of right to repair devices, not all digital technology devices are equal. A router used in a home is fundamentally different from the infrastructure equipment used to manage a power grid or secure confidential state agency data, Lee said.Chris Bresee, a lobbyist with the National Electrical Manufacturers Association, also highlighted the fact that, broadly, there is IT equipment that will need repairs at data centers.A growing number of products in data centers with connection to our electric grid as well. It is of the utmost importance to safeguard these critical systems, he said. This is not an argument against repair or against consumers rights, it is a recognition that fixing a smartphone is not the same as modifying systems that keep the lights on for our country.The argument being made by these lobbyists and major tech companies is that only the manufacturers or their authorized representatives should be allowed to fix these types of electronics. But, again, the definition of critical infrastructure is so broad that it can be applied to almost any type of electronic, and there is nothing fundamentally different between a router used at a data center and a router used in a school, business, or home.You look at who is backing this bill, it is large firms like Cisco and IBM. They sell information technology equipment to tens of thousands of Colorado businesses, and they are looking to create a de facto monopoly on that service, which exists in the states that have denied this business to business right to repair, Paul Roberts, a cybersecurity expert and founder of SecuRepairs testified. The big tech companies backing the bill are using a very real concern about cybersecurity and resilience of US critical infrastructure to pad their bottom line, locking in a monopoly on service and repair. Security Council resolution aimed at reopening the Strait of Hormuz that had been repeatedly watered down in hopes those two countries would abstain.The vote 11 in favor, two against and two abstentions took place just hours before an 8 p.m. Eastern deadline set by U.S. President Donald Trump for Iran to open the strategic waterway or face attacks on its power plants and bridges. One-fifth of the worlds oil typically passes through the strait, and Irans stranglehold during the war has sent energy prices soaring.Its doubtful the resolution, even if it had been adopted, would have impacted the war, now in its fifth week, because it was been significantly weakened to try to get Russia and China to abstain rather than veto it.The initial Bahrain proposal would have authorized countries to use all necessary means U.N. wording that would include military action to ensure transit through the Strait of Hormuz and deter attempts to close it. After Russia, China and France, all veto-wielding countries on the 15-member Security Council, expressed opposition to approving the use of force, the resolution was revised to eliminate all references to offensive action. It would have authorized only all defensive means necessary. A vote had been expected on Saturday. But instead the resolution was further weakened to eliminate any reference to Security Council authorization which is an order for action and limit its provisions to the Strait of Hormuz. Read More The resolution vetoed Tuesday strongly encourages states interested in the use of commercial maritime routes in the Strait of Hormuz to coordinate efforts, defensive in nature, commensurate with the circumstances, to contribute to ensuring the safety and security of navigation across the Strait of Hormuz. This should include escorting merchant and commercial vessels, and deterring attempts to close, obstruct or interfere with international navigation through the strait, it says.The resolution also demanded that Iran immediately halt attacks on merchant and commercial vessels and stop impeding their freedom of navigation through the Strait of Hormuz and attacking civilian infrastructure.In response to the U.S. and Israeli attacks beginning on Feb. 28, Iran has targeted hotels, airports, residential buildings and other civilian infrastructure in more than 10 countries, including the Islamic Republics Gulf neighbors, some of the worlds major exporters of oil and natural gas.Irans blockade in the strait is seen by Gulf nations as an existential threat. Bahrain, a Gulf nation that hosts the U.S. Fifth Fleet and is the Security Councils Arab representative and its president this month, has been pressing for U.N. action.At the same time, Trump on Monday demanded again that Iran reopen the Strait of Hormuz after heaping praise on the U.S. military for the daring rescue of two crewmen of a fighter jet shot down in Iran. The Republican president warned Iran that the entire country can be taken out in one night, and that might be tomorrow night. He repeated the warning on Tuesday, saying a whole civilization will die tonight if Tehran does not meet his deadline to agree to a deal that includes reopening the Strait of Hormuz.Russias U.N. Ambassador Vassily Nebenzia and Chinas U.N. Ambassador Fu Cong have blamed the U.S. and Israel for starting the war and sparking an expanding global crisis. They told the Security Council last week that the most urgent priority now is to end military operations immediately.In response to Irans strikes against its Gulf neighbors, the Security Council adopted a Bahrain-sponsored resolution on March 11 condemning the egregious attacks and calling for Tehran to immediately halt its strikes.That resolution, adopted by a vote of 13-0 with Russia and China abstaining, also condemned Irans actions in the Strait of Hormuz as a threat to international peace and security and called for an immediate end to all actions blocking shipping. (AP) Environmental groups on Tuesday asked a federal appellate court panel to drop its temporary halt of a lower courts order instructing state officials to close an immigration detention center in the heart of the Florida Everglades known as Alligator Alcatraz.The Everglades facility remains open, still holding detainees, because the appellate court in early September relied on arguments by Florida and the Trump administration that the state had not yet applied for federal reimbursement, and therefore wasnt required to follow federal environmental law. State officials opened the detention center last summer to support President Donald Trumps immigration crackdown.Questions by the three appellate judges during oral arguments in a Miami courtroom focused on how much control the federal government had over the state-built facility and under what circumstances an environmental review was required to be in compliance with federal law. The judges did not indicate when they would rule. Jesse Panuccio, an attorney for the Florida Department of Emergency Management, told the judges federal funding and federal control of the facility were the two criteria for determining if the federal environmental law would apply and the federal agencies had no control over the state-run detention center. That judge concluded that a reimbursement decision already had been made. The appellate court halted the order on an appeal.The environmental lawsuit was one of three federal court challenges to the Everglades facility since it opened. In the others, a detainee said Florida agencies and private contractors hired by the state had no authority to operate the center under federal law. The challenge ended after the immigrant detainee who filed the lawsuit agreed to be removed from the United States. The States House and Senate have both passed LD 307, a bill that would pause construction on new datacenters until November 1, 2027. The Senate approved LD 307 by a vote of 19-13 on Monday night and now it will go to both chambers for a final vote. LD 307 specifically targets datacenters of 20 megawatts or more and calls for the creation of a Maine Data Center Coordination Council to better plan and facilitate the massive construction projects.We cant afford health care for our constituents. Tim Nangle said during debate about the vote, according to the Maine Morning Star.Maines vote comes days after journalists at The Maine Monitor and Maine Focus revealed a secretive plan to construct a datacenter in the town of Lewiston in the southern part of the state. In Lewiston, city councilors didnt learn about the proposed $300 million datacenter until six days before they were supposed to vote on it. Discussions about the datacenter occurred behind closed doors and the city administrator said the developer had asked for confidentiality. In Wiscasset, the city killed a $5 billion proposed datacenter after residents learned the city had signed nondisclosure agreements with the developer.As part of the moratorium, Maines Data Center Coordination Council would study and oversee the environmental impact and electricity bill increases datacenters often bring to local residents and consider data-sharing requirements and processes for proposed datacenters.Anger against datacenters is mounting across the country. The massive complexes arent good neighbors. They use public land, increase the electricity rates of everyone near them, and have negative effects on water quality and noise levels. The deals to construct them are sometimes cut in secret and local communities have little to no say in whats being built near them. In Texas, a 6,000 acre datacenter plans to consume water from a dwindling aquifer to power nuclear power plants in the desert. In Michigan, a township is pushing back against a $1.2 billion AI datacenter meant to service Americas nuclear weapons scientists.In Port Washington, Wisconsin, citizens will vote directly on the issue this week. The town of 13,000 is voting directly on whether or not to allow an OpenAI Stargate datacenter project. Similar ballot measures are slated in Monterey Park, California, Augusta Township, Michigan, and Janesville, Wisconsin.In communities with no ballot measures, citizens are letting politicians know they hate datacenters in other ways. Early Monday morning, someone fired a gun at the home of Indianapolis City-County Councilor Ron Gibson and left a note on his front porch that read NO DATA CENTERS. (AP Photo)2026-04-07T14:02:22Z BAGHDAD (AP) The powerful Iran-backed Iraqi militia Kataib Hezbollah said in a statement on Tuesday that it will release American journalist Shelly Kittleson, who was kidnapped from a Baghdad streetcorner last week.The group said its decision came in appreciation of the patriotic stances of the outgoing prime minister, Mohammed Shia al-Sudani, without giving more details. It added that this initiative will not be repeated in the future.Kataib Hezbollah had not previously acknowledged that it was the one responsible for Kittlesons abduction, although both U.S. and Iraqi officials had pointed fingers at the group.Kittleson, 49, a freelance journalists, had lived abroad for years before the kidnapping, using Rome as her base for a time and building a respected journalism career across the Middle East, particularly in Iraq and Syria. Like many freelancers, she often worked on a shoestring budget and without the protections afforded by large news organizations to staff. She had entered Iraq again shortly before her abduction. U.S. officials have said that they warned her multiple times of threats against her, but that she did not want to leave. Iraqi officials have said that two cars were involved in the kidnapping, one of which crashed while being pursued near the town of al-Haswa in Babil province, southwest of Baghdad. The journalist was then transferred to a second car that fled the scene. Read More Three Iraqi officials said earlier Tuesday that attempts to negotiate her release had run into obstacles.The two Iraqi security officials and one official from the pro-Iran Coordination Framework political bloc spoke to The Associated Press on condition of anonymity because they were not authorized to speak about the sensitive case publicly.One of the security officials said that an official with the Popular Mobilization Forces, a coalition of Iran-backed militias that is nominally under the control of the Iraqi military, had been tasked with communicating with the abductors to secure Kittlesons release but had run into difficulties in communicating with the Kataib Hezbollah leadership. The primary challenge is that the leaders of the Kataib militia specifically, the commanders of the battalions are nowhere to be found. No one knows their whereabouts, and the process of establishing contact with them is extremely complex, they said. These leaders have gone underground, maintaining no active lines of communication, out of fear of being targeted.The political official said a message had been sent to the Kataib leadership to determine their demands in exchange for releasing the kidnapped journalist. Iraqi authorities are willing to release six Kataib Hezbollah members who are currently detained, most of them in connection with attacks on a U.S. base in Syria, they said, but the militia has not yet communicated its demands clearly.The second security official said that to further complicate matters, the Iraqi official in charge of the case has not yet received the go-ahead from U.S. officials to proceed with negotiations. U.S. officials did not immediately respond to requests for comment.
