Subscribe to our Newsletter today The Smiths contend that the new law violates their First Amendment rights by banning them from expressing their Christian beliefs about sexuality and gender in their store and on their website, and by forcing them to affirm trans and gender-nonconforming peoples identities, according to the lawsuit.Although Born Again Used Books happily sells its products to everyone, Colorado now compels the bookstore to speak using pronouns and titles based on a persons preferred gender expression thereby requiring the store to prioritize a persons professed identity over biological reality, a press release from AllianceDefending Freedom states.The Bookstore cannot speak contrary to its beliefs, the press release continues. So the store cannot use pronouns, titles, or any other language contrary to a persons biological sex. To do so would be to affirm the view that a persons sex can and sometimes should be changed a view that contradicts the Bookstores Christian beliefs. The Smiths argue that the law forces them either to abandon their core religious beliefs or face liability, including potential cease-and-desist orders, expensive investigations, hearings, and hefty fines.The lawsuit, which names the Colorado Civil Rights Commission and state Attorney General Phil Weiser as defendants, seeks a preliminary and permanent injunction preventing enforcement of the updated Colorado Anti-Discrimination Act against the Smiths and third-party speakers similarly situated to Born Again Used Books for their constitutionally protected speech, association, assembly, due process, free press, religious exercise, and equal protection rights.As MetroWeekly notes, the lawsuit is just the latest challenge to state anti-discrimination laws brought by Alliance Defending Freedom on behalf of anti-LGBTQ+ Christian business owners.Prior to the passage of the Kelly Loving Act, the organization, which the Southern Poverty Law Center has designated as a hate group, represented Masterpiece Cakeshop owner Jack Phillips in a case centered around whether Phillips violated the Colorado Anti-Discrimination Act when he refused to make a gender reveal cake for lawyer Autumn Scardina, who is trans, in 2019. Related Defense Department stops boat renaming project after only changing the one named for Harvey Milk They said ships shouldnt be named for civil rights leaders, but only the one named for the LGBTQ+ leader appears to be changing. The 19-page report, obtained by 404 Media through a Freedom of Information Act request, is a laundry list of attacks on trans identity; diversity, equity, and inclusion (DEI) efforts; and freedom of the press, in keeping with the Trump administrations illiberal crusade against them. Subscribe to our Newsletter today Among dozens of actions detailed in the report, the Pentagon said that it will monitor intimate spaces to ensure ongoing compliance with Executive Order 14168.What that bathroom monitoring looks like by surveillance cameras, assigned military personnel, genital checks, or others means was not included in the summary.Trump declared war on trans identity with his Gender Ideoloy executive order issued in January, which vows to restore biological truth to the federal government.In concert with Trumps anti-DEI executive order, the administration has ordered federal agencies to erase trans identity from all aspects of the federal government. At the Pentagon, that includes a ban on trans military service that took effect in May.Departments and agencies were required under the order to submit reports detailing compliance with the presidents fight against gender ideology. 404 Media reports that it has seenmemos for 11 different agencies, and the vast majority are generic and one or two pages long. Hegseths memo is 19 pages long, including three different exhibits. Among other actions detailed in the report are the steps that Hegseth has taken in his enthusiastic embrace of Trumps censorious orders: instituting a review hold on editorial content for Stars and Stripes, the militarys ostensible independent news publication; purging the Pentagon of personnel promoting or inculcating gender ideology; shutting down all social media at all levels of the department to prepare for reorientation of content on platforms; and stripping the term gender from all Pentagon communications and signage, including for those monitored bathrooms.In addition to Hegseths obsession with hunting down trans people in the Pentagons intimate spaces, including bathrooms and locker rooms, the summary illuminated the the former Fox News hosts instinct for censoring Pentagon communications. The unprecedented review hold on questionable content at Stars and Stripes is a form of prior restraint never seen in the history of the publication, which dates back to the Civil War.Trump tried to muzzle the outlet in his first administration, as well. In 2020,its top editor said Stars and Stripes is part of a free press free of censorship, free of command interference, free of prior restraint or prior review. Every time the Macrons leave their home, they do so knowing that countless people have heard, and many believe, these vile fabrications. It is invasive, dehumanizing, and deeply unjust.The Macrons said Owenss content is built on provocation, not truth and is not intended to inform but to inflame and attract attention through sensationalism and conspiracy theories.The relentless and unjustified smear campaignto which the lawsuit refers began in June 2024, when Owens glommed onto wild speculation from two women who were found liable for defamation after claiming Brigitte Macron was actually her own real-life brother, Jean-Michel Trogneux, transitioned into a woman. (Trogneux was present at the defamation trial.)Owen went on to create an eight-part podcast series in which she investigated Brigitte Macrons gender identity. Owens published the series and related X posts with reckless disregard for the truth, the lawsuit states. Owens was repeatedly presented with credible, verifiable evidence disproving her claims including documentation, public records, and direct outreach from the Macrons. Instead of correcting the record, she doubled down Owens, fully aware of the truth, has not only declined to retract her statements but has actively expanded on them.In August 2024, Owens said shed stake her professional reputation on the claim that Brigitte Macron is, a perverted transgender woman who was a man when she met and raped the French president when he was 14.In reality, Macron and Brigitte first met when he was 15 and she was a 40-year-old instructor at his high school. As a college newspaper columnist, Divine reportedly compared homosexuality to bestiality and any form of sex that goes against the biological design of procreation and the nurturing of a family. He argued that conservatives who oppose same-sex marriage do so not out of hate but because they are opposed to a group receiving extra benefits. His net approval rating has dropped nearly 20 points in the aggregate since the beginning of his presidency, Enten explained. The American people do not like what theyre seeing, and Donald Trumps administration is in a ton of trouble at this point in the minds of the American voters.He then broke down voter disapproval by issue.[Hes] minus-five points on immigration his best issue, hes underwater. How about the economy? That was what he was elected for minus-14 points. How about foreign policy? Minus-14 points. How about trade and those tariff wars? Minus-15 points. And, of course, the Epstein case, thelowestof the bunch, minus-37 points, 37 points below water. Indeed, even some of the most ardent Trumpers are turning on the president due to his administrations treatment of the Jeffrey Epstein files. Trump has lashed out at supporters for their anger that he wont release files about the late sex trafficker that the administration has long been dangling in front of them. He has continued to try to convince people to forget about Epstein, despite the fact that the MAGA world has been obsessed with the case for years and despite the fact that Trump, himself, has fueled that obsession.Many have speculated that the reason more information has not been released is because Trump himself or at least high-ranking members of his administration was actively involved in Epsteins misdealings. Trump who has been accused of sexual assault or other forms of sexual improprietyby at least 27 women had a decades-long friendship with Epsteinand joked about how his friend was fun and terrific andliked women on the younger side.The Epstein issue appears to be the one thing that his most devoted fans cannot explain away or forgive him for, though as Enten shows, its far from the only issue people are unhappy with. No matter it seems what Donald Trump does, the American people do not like it, Enten concluded. He then joked that his one piece of good news for the president is that there is one other presidency that had a lower net approval rating at this point than this one. The bad news is that it was Donald Trumps other presidency, he revealed. He also pointed out that at this point in a presidency, the average president since 1953 has enjoyed a plus 27 net approval rating, further emphasizing just how poorly Trump is polling. It seems to me that Donald Trump is about 40 points lower than the average president at this particular point, Enten concluded. He has the second-worst net approval rating at this point. He is underwater on all the major issues of the day. The bottom line is, six months into this administration, I think that most Americans would apply the word or words disaster, terrible, awful, horrible. I think that is the way that the American people would see it at this particular point. LGBTQ+ sex experts explain & give tips for how to do it rightThe terms bottom and top have been around since the gay leather scene got its start in the 50s, but while most people know what it means when youre talking about gay sex terms to differentiate between someone who likes to be penetrated during sex and the one who wants to penetrate what is a lesbian bottom?The terms top and bottom may have been coined by and for gay men, but the broader queer community and especially sapphics have taken to using the terms to describe sexual dynamics too. Even the straights have tried to co-opt the terms, though they consistently get it wrong and conflate top and bottom with dominant and submissive.They clearly have never met a bossy bottom, power bottom, or service top. But it can get complicated in sapphic relationships because queer women are more likely to both give and receive sexual pleasure in a relationship, unless they are a stone top or a pillow princess. And while being a bottom usually refers to a preference in positions, it can also be shorthand for a sexual dynamic especially in sapphic relationships. So what exactly is a "lesbian bottom?" To figure it all out, we talked to LGBTQ+ sex and relationship experts to find out what a lesbian bottom really is, and some tips and tricks for being the best lesbian bottom around.What is a lesbian bottom?Ok, so you know what gay men mean when they say theyre a bottom, but what is a lesbian bottom?When sapphics or lesbians talk about being a bottom,' theyre typically referring to a partner who enjoys receiving touch, sensation, or stimulation during sex whether thats physical or emotional, Emily Lambert Robins, a licensed clinical social worker and AASECT-certified sex therapist, tells PRIDE. Its less about a rigid role and more about a preference for surrender, receptivity, and being attuned to what feels good when letting someone else take the lead.These terms seem simpler when a dick is in play, and penetration is usually on the sexual menu, but for sapphics, it can look a little different. For some, that can look like being on the receiving end of oral sex, strap play, or sensual touch. For others, it might be more about an emotional dynamic rooted in trust, vulnerability, and responsiveness, Robins continues. Just like some people try to peg bottoms as always being submissive and tops as always dominant, people tend to pigeonhole butch and femme lesbians into specific roles in the bedroom, but butch bottoms and femme tops do exist.What's important to note here is that these terms reflect identities that help people understand and communicate to others what they find fulfilling, pleasurable, or affirming, explains Willow Sipling, an LGBT advocate, subject matter expert, and sociologist.Is it all about positions?Sexual positions are just part of the picture. Lesbian tops are more likely to be the one strapping, or giving oral sex, but thats not all the term encompasses. While physical positions may play a role, being a bottom often speaks to a certain energetic position: one of openness, willingness, and connection, Robins says. Some bottoms love being guided or done to, while others express strong preferences and communicate boundaries clearly. Its a dance of power, trust, and pleasure that can look different depending on the relationship, mood, or moment. The key is how the experience makes someone feel, not how it looks from the outside.According to Byrd, a certified sex educator who specializes in queerness from Sex Ed With Byrd, lesbian bottoms also want to relinquish control. Being a lesbian bottom isnt just about who's receiving or whos on the bottom physically, they explain. Among lesbians and sapphics, bottoming often blends physicality, sensation, emotional dynamics, and power play, but it doesnt always include all of those at once. For some, its a preference for receiving pleasure. For others, its about being submissive in bed. And sometimes, its just a playful label that helps describe a dynamic thats hard to name otherwise.What makes a good lesbian bottom?A good lesbian bottom doesnt need to perform in a specific way, Robins says, but should be present, communicative, and connected to their body and be self aware enough to know what feels good and what doesnt, is open to trying new things, expresses both boundaries sand desires clearly, and is responsive in bed so that your top can understand your desire by paying attention to your word, sounds, or movement.Women, and femme presenting people, are socialized to be giving and helpful and so it can be difficult to set that social conditions aside be a little greedy about your own pleasure, but Byrd points out that being a good lesbian bottom means allowing yourself to receive, without guilt or pressure to perform.Tips for improving your bottoming skillsPlay with power dynamics! For some lesbians and sapphics, bottoming and submission are connected. WWW.PRIDE.COM'King of Drag's clown prince Big D's art is no laughing matter but he's hilarious (exclusive)While Big D might not have taken home the title of King of Drag, he is, without a doubt, the shows clown prince. This Portland-based king quickly became a fan favorite when he flounced into the Man Cave in character as a foppish dandy. Then, despite being picked last when the cast broke into two boy band groups, he blew the audience, his castmates, and the judges who included director Paul Feig, who said he was the complete package away. It was an outcome that Big D, who didnt even think they would make it through the audition process, didnt see coming. I was convinced I wasn't going to get on, he recalls to PRIDE. I had to have several of my close friends hard pep talk me into applying. It was a lot of work to apply, and I was just like, I'll never make it. Why am I even bothering? But the chance of working with King of Drag host Murray Hill, the king who inspired him to get into drag in the first place, was just too good an opportunity for him to pass up. Much to Big Ds surprise, even applying gave him his first boost of confidence. The process of applying made me feel like, okay, you know, I'm at least somebody, Big D explains. It's okay for me to apply. I'm not an embarrassment to my application. It was a cycle of imposter syndrome and affirmation that repeated itself throughout the entire casting experience. I got called back, and I was shocked and amazed, but I still didn't think it would go anywhere. I did the callback, and it went really well, and I felt really good about it, but I still was like, oh, I probably didn't make it. And then, they made me wait a whole week, and I was at that point convinced I hadn't gotten it, he recounts. Then I got an email, and I was like, Oh well, they sent me an email. It's probably a rejection, and then it's like, we're thrilled and honored. And I was like, oh, okay, oh, and I still had to take my daughter up for a nap at that moment. I was like, okay, girl, got your milk. Let's go upstairs.His fear then was that he wouldn't fit in with his fellow kings, most of whom cut their teeth doing club gigs and lip-synching to screaming crowds. I haven't really put myself in the ring, in any way, with any other drag artists. Because I'm kind of in this clown and theater world, he explains. I just didnt see myself in the same kind of category.But that all changed when he walked into the Man Cave. I'm, like, you know what? I'm awesome, he recalls thinking. I felt like, okay, I must have something that they want, right?He couldnt have been more correct. Big Ds brand of clownery not only brought an enormous amount of levity to the already positivity-filled show but had a big impact on his competitors. My mind was just blown open, Alexander the Great recalls to PRIDE of watching Big Ds performance on the second episode, in which he impersonated Sylvester Stallone attempting to fold a fitted sheet. Buck Wylde is sitting next to me, and we're watching [Big D] do this, like, as we're filming, and I'm laughing so hard. I'm like, almost like, peeing myself, he says with a laugh. Never in a million years would I have thought of that.Thats not to mention the moral support he gave his brothers when they found themselves struggling. Tuna Melt recalls filming the first episode, during which he was struggling, both mentally and physically, at the end of a long day and a performance he was unhappy with. Big D was next to me backstage, and was just looking at me and just started talking to me, Tuna tells PRIDE. And I was like, you know what? This is why I did the show, so I can get to know Big D... and I'm going to choose to be present with my castmates."Today, Big D sees things more clearly and understands why he was in the room with his fellow kings. I wish I could have told [this to] the me who was convinced I wasn't going to get on [the show]. First of all, the world that calls itself the drag world is extremely available and inclusive of a lot of different definitions of what that is, he shares, adding, The art form is expansive and expanding, and there's room. If you're a serious artist who is playing with gender, there's probably a place for you in this world.While he's proud to be making drag king history as part of the first cast and to be a part of the first season of the groundbreaking series, hes not letting the pressure get to him. One of the benefits of being a mid-career artist, you know, is that you give less and less fucks, he says. This is certainly my first time being on TV, but it's not my first rodeo as a performer. I just have to do the damn thing.Still, the experience proved revelatory for Big D, who feels changed by his time on the show. For one, it has pushed back on the impostor syndrome that he says often plagues AFAB performers. I've been really serious about my art and really playing with gender for a really long time. And I don't know why I didn't feel legitimate then, but I do now, he admits.Theres a bit of delicious irony here considering that Big D explains his drag is, in part, an exploration of mediocre masculinity.My shitty makeup is a testament to my masculinity. I'm gonna put on shitty ass makeup and tell everyone I look fabulous because I'm a fucking mediocre white man. Get into it! he jokes.That's what it is to be a mediocre white man, to say, like, I am enough, even though I'm not enough.Kinging is also a space thats given Big D the freedom to embrace himself just as he is, including being a self-professed menopausal king, and allows more room for performers of various ages, because, well, patriarchy. In some ways, [we have] all of the benefits of the patriarchy we can use and apply in terms of [the] drag kingdom, he explains. [Like] the idea of taking up more space than we deserve. This idea [of men] getting better as they age. I'm not even climaxing yet as a drag king. There's still further to go. I don't feel too old. I think that that is one way in which drag queendom is harder, because I think society is harder on women as they age, right? he says, So it's going to be harder on drag queens. But it could be very gentle on drag kings. Very nice for us as we get older, right? We could just get sexier and sexier. So I'm looking forward to that.However, hes quick to add that hes ready for kinging to break free of being contextualized through the lens of queens. I love Drag Race, but that is not how I want to be talked about or defined, he says.In fact, he has his own uniquely Big D way of describing what hes doing with his drag. Some really famous drag kings, like Adam All or Landon [Cider], are really interested in rebranding masculinity, or taking away the toxic and making it like a new kind of masculinity, he says, adding he has a different approach. I'm riding the coattails of toxic masculinity. I'm right behind the toxic masculinity, eating its poop and farting out gold.He laughs at his own, ahem, evocative description and adds, I'm a clown, I'm an idiot. I'm here to be laughed at, and my job is to take toxic masculinity and make it funny.Big D also hopes that his presence on the show helps to educate the audience about what clowning means, that its not just about circus tents and oversized shoes, but rather a much deeper way to access and exorcise deep trauma and personal struggles by turning them into comedy. The way I define clowning is, there's a deep connection to the audience, he begins. It's about finding comedy from who I am, from my strengths and, more than that, my weaknesses, my vulnerabilities. So it's like taking the stuff about me that's authentic, and maybe I'm not proud of some of it, but like, that's who I am.For example, the character Big D embodied as he walked into the Man Cave on the first day, unpacks a side of himself that he describes as pompous and artistic and flowery and just so stupid.The way he approaches characters is to find the places within himself where he feels the most shame. Gender stuff was one of my top things that I was ashamed of. So, I started doing characters that were masculine impersonators because that's what I like. That was something that I was like, Oh, God, I hate this about myself. [Then] okay, I'm going to clown through it. I'm going to put it out there in the world so that people can laugh at it. And through that, I'm going to feel some healing.He, happily, has found some, and it's been a journey that continued on King of Drag. [When] I started, [I thought] Im a garbage King. I have nothing. I have no looks, whatever. And then I started to be like, No, actually, I do have looks. I do care about details, I do care about looks. It's not perfection, but there's something. And I leaned in, he says, adding that this most recent episode, which was a design challenge, was eye-opening. I've always thought of myself as punk, but it really helped me clarify that [and] be like, Yeah, that's what I'm doing.It also marked his first public lip-sync. My brothers on the show, they come from this nightclub scene where it's like, you walk out on stage and people are screaming and throwing money at you, right? he explains. I'm used to walking out on stage to eight senior citizens in fucking Edmonton, Alberta, just like, sitting there being like, is this anything? It's a very different vibe. This experience awakened something in Big D, who is now seeking ways to further marry his clowning with lip-syncing although he remains thoughtful about how he will go about it. I'm a parent, and so I have to be tactical about when I travel, he points out.Also, teaching remains his truest passion. It's really important for me to spread what I do through teaching and helping other people make work that's just as important to me as performing. I love performing, but I think a lot of performers teach to support the performing habit. And I would say that I perform to support my teaching habit, he admits. Its clear that clowning changed his life for the better, and his mission is to make sure more people have access to that same experience.Hes also open to doing more TV, so long as it's on his terms. One of the reasons why I look up to Murray [Hill] so much is that he's been able to make this movement into TV and film in such an authentic and true-to-himself way. I would definitely love that, he says. But for now, Big Ds just reveling in an experience that left him feeling both supported and featured, and he dreams of a time when more kings feel the same way. I wish that for all artists who work hard, you know, and have something to share, he says. It's so hard for artists to feel that kind of support, and it is game-changing.He also has a message for his fans. I want people reading [this] to go [and] reach out to some artist who matters, who's maybe off the radar, someone who's not getting a PRIDE article written about them. On March 15, President Donald Trumps administration sent more than 230 Venezuelan immigrants to a maximum-security prison in El Salvador. Without providing evidence, Trump has called the men some of the most violent savages on the face of the Earth.Last week, the men were released as suddenly as theyd been taken away. Now, the truth of all their stories one by one will begin to be told. Starting here. Weve compiled a first-of-its-kind, case-by-case accounting of 238 Venezuelan men who were held in El Salvador. ProPublica, The Texas Tribune and a team of Venezuelan journalists from Alianza Rebelde Investiga (Rebel Alliance Investigates) and Cazadores de Fake News (Fake News Hunters) spent the past four months reporting on the mens lives and their backgrounds. We obtained government data that included whether they had been convicted of crimes in the U.S. or had pending charges. We found most were listed solely as having immigration violations. We also conducted interviews with relatives of more than 100 of the men; reviewed thousands of pages of court records from the U.S. and South America; and analyzed federal immigration court data.Some of our findings:We obtained internal data showing that the Trump administration knew that at least 197 of the men had not been convicted of crimes in the U.S. and that only six had been convicted of violent offenses. We identified fewer than a dozen additional convictions, both for crimes committed in the U.S. and abroad, that were not reflected in the government data.Nearly half of the men, or 118, were whisked out of the country while in the middle of their immigration cases, which should have protected them from deportation. Some were only days away from a final hearing. At least 166 of the men have tattoos. Interviews with families, immigration documents and court records show the government relied heavily on tattoos to tie the men to the Venezuelan gang Tren de Aragua even though law enforcement experts told us that tattoos are not an indicator of gang membership. The men who were imprisoned range in age from 18 to 46. The impact of their monthslong incarceration extended beyond them. Their wives struggled to pay the rent. Relatives went without medical treatment. Their children wondered if they would see them again.White House spokesperson Abigail Jackson did not respond to questions about the men in the database but said Trump is committed to keeping his promises to the American people and removing dangerous criminal and terrorist illegals who pose a threat to the American public. Louisiana passed a new police accountability law following allegations of civil rights violations against a sheriffs deputy caught on video dragging a Black woman by her hair and slamming her head into the ground.The woman, Shantel Arnold, sued the deputy and the sheriff, accusing the Jefferson Parish Sheriffs Office of conspiring to cover up the 2021 assault. The Sheriffs Office agreed in March to pay Arnold $300,000 after three days of trial but before jury deliberations began, Arnolds attorney said.After the incident, ProPublica, in partnership with WRKF, WWNO and The Times-Picayune, published an investigation detailing the long history of excessive-force complaints against Jefferson Parish sheriffs Deputy Julio Alvarado. Alvarado, a 20-year veteran of the Sheriffs Office, was employed by the department as of March.Arnolds attorney, state Sen. Gary Carter, D-New Orleans, said he introduced the legislation after it emerged that Alvarado had failed to write a report about his encounter with Arnold despite his departments policy that officers document each time they use force. Jefferson Parish Sheriff Joseph Lopinto said during his testimony in the March trial over Arnolds lawsuit that Alvarados commanders instructed him against writing such a report after video of his actions spread across social media.Arnolds run-in with Alvarado, which was captured in a 14-second video, left the woman with bruises and scratches across her body, a busted lip and recurring headaches, according to her subsequent account to police investigators.Had it not been for a bystander capturing how this officer beat up Shantel Arnold, there would be no report, there would be no evidence of it, there would be no indication that it ever happened, Carter said in a recent interview.The new law, passed unanimously by state legislators and signed by Gov. Jeff Landry in June, will require all law enforcement agencies to report every time an officers use of force results in serious injury. It directs the Council on Peace Officer Standards and Training, which certifies police officers, to adopt a policy on mandatory use-of-force reporting by Jan. 1. Details of how the process will work have not been spelled out, nor has the penalty for failing to comply. The bill was introduced as Shantel Arnolds Law, but Carter said that name was removed because Sheriff Lopinto got very upset about that, and that almost killed the bill.Neither the Jefferson Parish Sheriffs Office nor Alvarados attorney responded to requests for comment or an interview.Alvarado came across Arnold in September 2021, when the officer responded to a 911 call about a fight among 25 people in Jefferson Parish. When the deputy pulled up in his patrol car, Alvarado saw Arnold, covered in dirt, walking down the street. Arnold told the deputy she was attacked by a group of boys who frequently bullied her. When Alvarado ordered her to stop, Arnold said she just wanted to go home and kept walking. Thats when the deputy jumped out of his vehicle, grabbed Arnold and slammed her into the sidewalk, according to several witnesses.In a video taken by a bystander, Alvarado drags Arnold along the pavement, holds her by her braids and slams her repeatedly onto the pavement. Arnold was not charged with a crime and was later taken to a hospital. The Sheriffs Office did not use body cameras at the time but has since begun using them.The Jefferson Parish Sheriffs Office denied wrongdoing. A 2022 internal investigation by the Sheriffs Office determined Alvarados actions against Arnold were both reasonable and acceptable. Alvarado received an approximately 40-hour suspension for failing to file a written report, Lopinto said in his March testimony.Arnold alleged in her 2022 lawsuit that the Sheriffs Office knew Alvarado had a propensity for violence against Black people and other minority groups yet continued to have him patrol such communities, putting the public in danger.Lopinto attributed Alvarados history of complaints to his working a high-crime beat, according to a 2022 Times-Picayune interview. Its not like hes getting a complaint every month, Lopinto said. During that same interview, Lopinto dismissed Arnolds account and accused her of looking for a paycheck.Alvarados alleged misdeeds fit a broader pattern in the Jefferson Parish Sheriffs Office, as the yearlong investigation into the Sheriffs Office by ProPublica, WRKF and WWNO found. Between 2013 and 2021, deputies disproportionately discharged guns against Black people. Of the 40 people shot at by Jefferson Parish deputies during that time, 73% were Black, more than double their share of the population. Twelve of the 16 people who died after being shot or restrained by deputies during that time were Black.Alvarado has been named in at least 10 federal civil rights lawsuits since 2007, all involving the use of excessive force; eight of the plaintiffs were members of minority groups. The Sheriffs Office settled three of those lawsuits. Arnolds $300,000 payout is the third and largest settlement involving Alvarado. Five other lawsuits were closed in favor of the Sheriffs Office, one was dismissed on a legal technicality and one was indefinitely delayed.The Sheriffs Office said in filings responding to the eight lawsuits that were not dismissed or delayed that officers actions were reasonable under the circumstances and characterized the claims as frivolous. Prior to the 2021 incident involving Arnold, the Jefferson Parish Sheriffs Office had settled a 2016 lawsuit accusing Alvarado of grabbing a 14-year-old Hispanic boy by the neck and slamming his head against the concrete as the child screamed, Why are you doing this to me? A woman had called the police complaining that the boy and a friend were wrestling in a parking lot. Alvarado then threatened to have the boy and his family deported, according to the suit. The Sheriffs Office, which paid the boys family $15,000, said in court filings that Alvarados actions were reasonable under the circumstances.In 2018, another lawsuit claimed Alvarado and three deputies beat Atdner Casco, a Honduran native, and stole more than $2,000 from him during a traffic stop the year before, then conspired to have him deported. Casco claimed Alvarado beat and choked him until he agreed to keep silent about being robbed. The Sheriffs Office denied wrongdoing but settled that case in 2020 for $50,000.Both incidents were cited in Arnolds lawsuit as evidence that Alvarado has exhibited a pattern of behavior throughout his career that made him unfit for duty. Carter, Arnolds attorney, raised yet another incident during the March trial in which sheriff detectives in December 2019 witnessed Alvarado patronizing a massage parlor that was being investigated for suspected prostitution. Alvarado denied he went there to have a sexual act performed on him. Kaila Farrell-Smith grew up in a community that was deeply involved in the fight for Indigenous rights, protesting broken treaties and other mistreatment of Native American people. Members of the movement, she said, understood that law enforcement agencies were surveilling their activities.Ive been warned my entire life, The FBIs watching us, said Farrell-Smith, a member of the Klamath Tribes in Oregon.Government records later confirmed wide-ranging FBI surveillance of the movement in the 1970s, and now the agency is focused on her and a new generation of Indigenous activists challenging development of a mine in northern Nevada. Farrell-Smith advises the group People of Red Mountain, which opposes a Canadian companys efforts to tap what it says is one of the worlds largest lithium deposits.Law enforcement agencies, including the FBI, have for years worked alongside private mine security to surveil the largely peaceful protesters who oppose the mine, called Thacker Pass, according to more than 2,000 pages of internal law enforcement communications reviewed by ProPublica. Officers and agents have tracked protesters social media, while the mining company has gathered video from a camera above a campsite protesters set up on public land near the mine. An FBI joint terrorism task force in Reno met in June 2022 with a focus on Thacker Pass, the records also show, and Lithium Americas the main company behind the mine hired a former FBI agent specializing in counterterrorism to develop its security plan. Were out there doing ceremony and theyre surveilling us, Farrell-Smith said.They treat us like were domestic terrorists, added Chanda Callao, an organizer with People of Red Mountain.All told, about 10 agencies have monitored the mines opponents. In addition to the FBI, those agencies include the Bureau of Land Management, Humboldt County Sheriffs Office, Bureau of Indian Affairs, Nevada State Police Highway Patrol, Winnemucca Police Department and Nevada Threat Analysis Center, the records show.Andrew Ferguson, who studies surveillance technology at the American University Washington College of Law, called the scrutiny of Indigenous and environmental protesters as potential terrorists chilling.It obviously should be concerning to activists that anything they do in their local area might be seen in this broad-brush way of being a federal issue of terrorism or come under the observation of the FBI and all of the powers that come with it, Ferguson said.The FBI did not respond to requests for comment. The Bureau of Land Management, which coordinated much of the interagency response, declined to comment. Most of the law enforcement activity has focused on monitoring, and one person has been arrested to date as a result of the protests.Mike Allen, who served as Humboldt Countys sheriff until January 2023, said his offices role was simply to monitor the situation at Thacker Pass. We would go up there and make periodic patrol activity, he said.Allen defended the joint terrorism task force, saying it was where we would just all get together and discuss things. (The FBI characterizes such task forces, which include various agencies working in an area, as the front line of defense against terrorism.) In this May 2022 email, an FBI special agent invites Nevadas Humboldt County Sheriffs Office to a joint terrorism task force meeting focused on Thacker Pass. Tim Crowley, Lithium Americas vice president of government and external affairs, said in a statement: Protestors have vandalized property, blocked roads and dangerously climbed on Lithium Americas equipment. In all those cases, Lithium Americas avoided engagement with the protestors and coordinated with the local authorities when necessary for the protection of everyone involved.Crowley noted that Lithium Americas has worked with Indigenous communities near the mine to study cultural artifacts and is offering to build projects worth millions of dollars for the Fort McDermitt Paiute and Shoshone Tribe, such as a community center and greenhouse.But individuals and the community groups opposed to the mine dont want money. They worry mining will pollute local sources of water in the nations driest state and harm culturally significant sites, including that of an 1865 massacre of Indigenous people.We understand how the land is sacred and how much culture and how much history is within the McDermitt Caldera, Callao said of the basin where Thacker Pass is located. (David Calvert/The Nevada Independent) A Familiar ConflictIndigenous groups are increasingly at odds with mining companies as climate change brings economies around the globe to an inflection point. Greenhouse gas emissions from burning fossil fuels are contributing to increasingly intense hurricanes, heat waves, wildfires and droughts. The solution powering the electrical grid, vehicles and factories with cleaner energy sources brings tradeoffs.Massive amounts of metals are required to manufacture solar panels, wind turbines and other renewable energy infrastructure. Demand for lithium will skyrocket 350% by 2040, largely to be used in electric vehicles rechargeable batteries, according to the International Energy Agency.The U.S. produces very little lithium and China controls a majority of refining capacity worldwide so development of Thacker Pass enjoys bipartisan support, receiving a key permit in President Donald Trumps first administration and a $2.26 billion loan from President Joe Bidens administration. (Development ran into issues in June, when a Nevada agency notified the company that it was using groundwater without the proper permit. Company representatives have said they are confident that they will resolve the matter.)Many minerals needed to produce cleaner energy are found on Indigenous lands. For example, 85% of known global lithium reserves are on or near Indigenous peoples lands, according to a 2022 study by researchers at the University of Queensland in Australia, the University of the Free State in South Africa and elsewhere. The situation has put Indigenous communities at odds with mining industries as tribes are asked to sacrifice land and sovereignty to combat climate change.Luke Danielson is a mining consultant and lawyer who for decades has researched how mining affects Indigenous lands. What I fear would be we set loose a land rush where were trampling over all the Indigenous people and were taking all the public land and essentially privatizing it to mining companies, he said.If companies or governments attempt to force mining on such communities, it can slow development, noted Ciaran OFaircheallaigh, a professor emeritus of Australias Griffith University and author of Indigenous Peoples and Mining.If there are bulldozers coming down the road and they are going to destroy an area that is central to peoples identity and their existence, they are going to fight, he said. The solution is you actually put First Peoples in a position of equal power so that they can negotiate outcomes that allow for timely, and indeed speedy, development. (David Calvert/The Nevada Independent) Were Not There for an UprisingMost of the documents tracing law enforcements involvement at Thacker Pass were obtained via public records requests by two advocacy groups focused on climate change and law enforcement, Siskiyou Rising Tide and Information for Public Use. They shared the records with ProPublica, which obtained additional documents through separate public records requests to law enforcement agencies.Given the monitoring of minings opponents highlighted in the records, experts raised questions about authorities role: Is the government there to support industrial development, protect civil liberties or act as an unbiased arbiter? At Thacker Pass, the documents show, law enforcement has helped defend the mine.Protests have at times escalated.A small group of more radical environmentalists led by non-Indigenous activists propelled the early movement, setting up a campsite on public land near the proposed mine site in January 2021. In June 2022, a protester from France wrote on social media, Well need all the AR15s We can get on the frontlines! Tensions peaked in June 2023, when several protesters entered the worksite and blocked bulldozers, leading to one arrest.That group which calls itself Protect Thacker Pass argued that its actions were justified. Will Falk, one of the groups organizers, said that, in any confrontation, scrutiny unfairly falls on protesters instead of companies or the government. As a culture, weve become so used to militarized police that we dont understand that, out of the group of people gathered, the people who are actually violent are the ones with the guns, he said.Falk and another organizer were, as a result of their participation in protests, barred by court order from returning to Thacker Pass and disrupting construction, and the Bureau of Land Management fined them for alleged trespass on public lands during the protest. The agency charged them $49,877.71 for officers time and mileage to monitor them, according to agency records Falk shared with ProPublica. Falk said his group tried to work with the agency to obtain permits and is disputing the fine to a federal board of appeals.None of us are armed. Were not there for an uprising, said Gary McKinney, a spokesperson for People of Red Mountain, which parted ways with Falks group before the incident that led to an arrest.McKinney, a member of the Duck Valley Shoshone-Paiute Tribe, leads annual prayer rides, journeying hundreds of miles across northern Nevada on horseback with other Native American activists to Thacker Pass. He described the rides, intended to raise awareness of minings impact on tribes and the environment, as a way to exercise rights under the American Indian Religious Freedom Act, which protects tribes ability to practice traditional spirituality. Still, the group feels watched. A trail camera once mysteriously appeared near their campsite along the path of the prayer ride. They also crossed paths with security personnel. Beyond the trail rides, the FBI tracks McKinneys activity, the records show. The agency informed other law enforcement when he promoted a Fourth of July powwow and rodeo on his reservation, and it flagged a speech he delivered at a conference for mining-affected communities.Were being watched, were being followed, were under the microscope, McKinney said. The records show security personnel hired by Lithium Americas speaking as if an uprising could be imminent. To date, there has been no violence or serious property destruction, however, the activities of these protest groups could change to a more aggressive actions and violent demeanor at any time, Raymond Mey, who joined Lithium Americas security team for a time after a career with the FBI, wrote to law enforcement agencies in July 2022.Mey also researched protesters activities, sharing his findings with law enforcement. In an April 2021 update, for example, he provided an aerial photograph of the protesters campsite. Law enforcement agencies worked with Mey, and he pushed to make that relationship closer, seeking an integrated and coordinated law enforcement strategy to deal with the protestors at Thacker Pass. The records indicate that the FBI was open to him attending its joint terrorism task force.Mey is not licensed with the Nevada Private Investigators Licensing Board, which is required to perform such work in the state, according to agency records.Mey said that he didnt believe he needed a license because he wasnt pursuing investigations. (David Calvert/The Nevada Independent) We Shouldnt Have to Accept the Burden of the Climate CrisisThe battle over Thacker Pass reflects renewed strife between mining and drilling industries and Indigenous people. Two recent fights at the heart of this clash have intersected with Thacker Pass one concerning an oil pipeline in the Great Plains and the other over a copper mine in the Southwest.Beginning in 2016 and continuing for nearly a year, a large protest camp on the Standing Rock Indian Reservation sought to halt construction of the 1,172-mile Dakota Access Pipeline. Members of the Indigenous-led movement contended that it threatened the regions water. The protest turned violent, leading to hundreds of arrests. Law enforcement eventually cleared the camp and the pipeline was completed.Law enforcement agencies feared similar opposition at Thacker Pass, the records show.In April 2021, Allen, then the local sheriff, and his staff met with Mark Pfeifle, president and CEO of the communications firm Off the Record Strategies, to discuss lessons learned from the Dakota Access Pipeline protests. Pfeifle, who helped the Bush administration build support for the second Gulf War, had more recently led a public relations blitz to discredit the Standing Rock protesters. This involved suggesting using a fake news crew and mocking up wanted posters for activists, according to emails obtained by news organizations. Pfeifle sent Allen presentations about the law enforcement response at Standing Rock, including one on Examples of Fake News and disinformation from the protesters. As always, we stand ready to help your office and your citizens, he wrote to the sheriff.The department appears not to have hired Pfeifle, although Allen directed his staff to also meet with Pfeifles colleague who worked on the Standing Rock response.Around July 2021, the Humboldt County Sheriffs Office held a meeting to plan for the reality of a large-scale incident at Thacker Pass similar to the Dakota Access Pipeline protests. Police referred to the ongoing protests on public land at Thacker Pass as an occupation.Allen said he didnt remember meeting with Pfeifle but said he wanted to be prepared for anything. We didnt know what to expect, but from what we understand, there were professional protestors up there and more were coming in, he said.Pfeifle didnt respond to requests for comment.Members of People of Red Mountain have also traveled to Arizona to object to the development of a controversial copper mine thats planned in a national forest east of Phoenix. There, some members of the San Carlos Apache Tribe oppose the development because it would destroy an area they use for ceremonies. (In May, the Supreme Court handed down a decision allowing a land transfer, removing the final key obstacle to the mine.)On these trips, Callao and others have frequently found a notice of baggage inspection from the Transportation Security Administration in their checked luggage. Despite the Trump administrations public pronouncements that it has hired enough wildland firefighters, documents obtained by ProPublica show a high vacancy rate, as well as internal concern among top officials as more than 1 million acres burn across 10 states.Less than a month ago, Agriculture Secretary Brooke Rollins announced that the Trump administration had done a historically good job preparing the nation for the summer fire season. We are on track to meet and potentially exceed our firefighting hiring goals, said Rollins, during an address to Western governors. Rollins oversees the wildland firefighting workforce at the U.S. Forest Service, a subagency of the Department of Agriculture. Rollins had noted in her remarks that the administration had exempted firefighters from a federal hiring freeze, and she claimed that the administration was outdoing its predecessor: We have reached 96% of our hiring goal, far outpacing the rate of hiring and onboarding over the past three years and in the previous administration.Since then, the Forest Services assertions have gotten even more optimistic: The agency now claims it has reached 99% of its firefighting hiring goal.But according to internal data obtained by ProPublica, Rollins characterization is dangerously misleading. She omitted a wave of resignations from the agency this spring and that many senior management positions remain vacant. Layoffs by the Department of Government Efficiency, voluntary deferred resignations and early retirements have severely hampered the wildland firefighting force. According to the internal national data, which has not been previously reported, more than 4,500 Forest Service firefighting jobs as many as 27% remained vacant as of July 17. A Forest Service employee who is familiar with the data said it comes from administrators who input staffing information into a computer tool used to create organization charts. The employee said that while the data could contain inaccuracies in certain forests, it broadly reflects the agencys desired staffing levels. The employee said the data showing active unfilled positions was current and up-to-date for last week. The Department of Agriculture disputes that assessment, but the figures are supported by anecdotal accounts from wildland firefighters in New Mexico, Oregon, Washington, California and Wyoming. According to a recent survey by Forest Service fire managers in California, 26% of engine captain positions and 42% of engineer positions were vacant. A veteran Forest Service firefighter in California characterized the Trump administrations current estimate of the size of its firefighting workforce as grossly inaccurate.Last week, Tom Schultz, the chief of the Forest Service, circulated a letter to high-ranking officials in the agency that underscored the dire moment. As expected, the 2025 Fire Year is proving to be extremely challenging, wrote Schultz in the letter, a copy of which was obtained by ProPublica. We know the demand for resources outpaces their availability. Schultz at once directed staff to employ full suppression stomping out fires as quickly as possible, instead of letting them burn for the sake of landscape management and acknowledged that the resources necessary to pursue such an aggressive strategy were lacking. All options were on the table, he wrote, including directing human-resources employees to fight fires and asking recently departed employees with firefighting qualifications to return to work.When asked about the discrepancy between Schultzs memo and Rollins public statements on firefighting staffing at the Forest Service, an agency spokesperson said that Schultz was referring to employees who can be called on to bolster the agencys response as fire activity increases, while Rollins was pointing only to full-time firefighters. The Forest Service remains fully equipped and operationally ready to protect people and communities from wildfire, the spokesperson said, noting that many individuals that have separated from the Agency either through retirements or voluntary resignations still possess active wildland fire qualifications and are making themselves available to support fire response operations.The federal government employs thousands of wildland firefighters, but the precise number is opaque. Throughout the Department of the Interior, which is overseen by Secretary Doug Burgum, there are about 5,800 wildland firefighters in four agencies that have been impacted by cuts. An employee at a national park in Colorado that is threatened by wildfire said that they were severely understaffed during the Biden administration on most fronts, and now its so much worse than its ever been.But the Forest Service is by far the largest employer of wildland firefighters, and it has long used gymnastic arithmetic to paint an optimistic picture of its staffing. Last summer, ProPublica reported that the Forest Service under President Joe Biden had overstated its capacity. Robert Kuhn, a former Forest Service official who between 2009 and 2011 co-authored an assessment of the agencys personnel needs, recently said that the practice of selectively counting firefighters dates back years. What the public needs to understand is, that is just a very small number of what is needed every summer, he said. Riva Duncan, a retired Forest Service fire chief and the vice president of Grassroots Wildland Firefighters, a labor advocacy organization, said staffing is a constant frustration for managers on the ground. We have engines that are completely unstaffed, said Duncan, who remains active in wildland firefighting, having worked in temporary roles this summer. We have vacant positions in management.That said, there is a difference this fire season from years past. Officials in the previous administration publicly acknowledged the danger presented by an exodus of experienced wildland firefighters. The Trump administration has taken a different approach claiming to have solved the problem while simultaneously exacerbating it. When asked about the staffing cuts, Anna Kelly, a White House deputy press secretary, wrote, President Trump is proud of all Secretary Rollins has accomplished to improve forest management, including by ending the 2001 Roadless Rule for stronger fire prevention, and Secretary Burgums great work protecting our nations treasured public lands.In March, Congress finally codified a permanent raise for federal wildland firefighters via the appropriations process, a change that advocates have sought for years. In her remarks in June, Rollins credited the president: Out of gratitude for the selfless service of our Forest Service firefighters, President Trump permanently increased the pay for our federal wildland firefighters.But in February, the Trump administration laid off about 700 employees who support wildland fire operations, from human-resource managers to ecologists and trail-crew workers. Those employees possess what are known as red cards certifications that allow them to work on fire crews. Many were subsequently rehired, but the administration then pushed Forest Service employees to accept deferred resignations and early retirements.Last month, President Donald Trump issued an executive order directing the Forest Service and the Department of the Interior to combine their firefighting forces. For the moment, its unknown what form that restructuring will take, but many Forest Service firefighters are anticipating further staffing cuts. A spokesperson for the Department of the Interior wrote, We are taking steps to unify federal wildfire programs to streamline bureaucracy.Administration officials have maintained that employees primarily assigned to wildland fire were exempted from the resignation offers this spring. But according to another internal data set obtained by ProPublica, of the more than 4,000 Forest Service employees who accepted deferred resignations and early retirements, approximately 1,600 had red cards. (A spokesperson for the Department of Agriculture wrote that the actual number was 1,400, adding that 85 of them have decided to return for the season.)Even those figures dont account for all the lost institutional knowledge. The departures included meteorologists who provided long-range forecasts, allowing fire managers to decide where to deploy crews. One of the meteorologists who left was Charles Maxwell, who had for more than 20 years interpreted weather models predicting summer monsoons at the Southwest Coordination Center in Albuquerque, New Mexico, an interagency office. The thunderstorms can fuel wildfire, with lightning and wind, and extinguish them, with great rains. Lately, according to Maxwell, the monsoons have become less and less reliable, and understanding their nuances can be challenging. Maxwell said that hed already been planning to retire next year. But he also said he was concerned with the degree of chaos, the potential degradation of services and what would happen to my job.Maxwell noted that his work had been covered by knowledgeable fill-ins from out of state. But another firefighter who worked on blazes in New Mexico said that Maxwells understanding of the monsoon had been missed. A spokesperson for the Department of the Interior, which oversees the interagency office where Maxwell worked, wrote, We do not comment on personnel matters.The monsoon season is now here and has brought deadly flash flooding along old burn scars in Ruidoso, New Mexico, while distributing sporadic rain in the states Gila National Forest.It is shaping up to be a severe fire season. On Monday, federal firefighters reported 86 new fires across the West; by Tuesday, there were 105 more. And theres already been some criticism of the federal response. Arizonas governor and members of Congress have called for an investigation into the Park Services handling of a blaze this month that leveled a historic lodge on the Grand Canyons North Rim. Last month, Rollins acknowledged, Fires dont know Republican or Democrat, or which side of the aisle you are on. This much, at least, is true.
